It shall hereafter be unlawful to operate a used car lot, used
car sales facility or used car storage facility, either wholesale
or retail in nature, in the City of Breckenridge Hills, Missouri,
without first obtaining a permit therefor from the Building Commissioner
of the City of Breckenridge Hills.

A.
Any
applicant for said permit shall submit with such application sufficient
plans and drawings and other written information as may be required
by the Building Commissioner from which said Building Commissioner
shall determine whether the application meets the following criteria,
to wit:
1.
Each such dealership, sales facility or storage facility shall contain
one (1) building of not less than three hundred (300) square feet
of floor area which is constructed of either masonry or frame construction
with masonry veneer and which is designed to contain office facilities
and at least one (1) sanitary lavatory and toilet facility and which
shall comply with all applicable building, fire and safety codes.
2.
Each such facility shall contain a minimum of twenty-five (25) clearly
marked parking spaces each of which shall be at least nine (9) feet
in width and eighteen (18) feet in depth and each of which shall allow
for vehicle ingress and egress without the necessity of moving any
other vehicle.
3.
No used car dealership, sales facility or storage facility shall
be constructed or operated on a lot having less than one hundred (100)
feet of frontage adjacent to a public street or which does not have
vehicular ingress or egress directly from the public street without
the necessity of crossing any other private property.
4.
No used car dealership, sales facility or storage facility shall
be built or operated upon any lot which contains less than seven thousand
five hundred (7,500) square feet of paved surface plus an additional
three hundred (300) square feet of paved surface for every parking
space provided thereon in excess of twenty-five (25) parking spaces.
5.
No used car dealership, sales facility or storage facility shall
be constructed or operated except in compliance with the provisions
of the Zoning Code of the City of Breckenridge Hills.

It shall be unlawful for the owner, operator or manager of any
used car dealership, sales facility or storage facility to suffer
or allow vehicles containing visible damage or vehicles from which
parts are visibly missing to remain parked or stored on the premises
of such dealership, sales facility or storage facility for a period
in excess of ten (10) days unless such vehicles are parked or stored
within an enclosed building. Penalty for each such day that any violation
hereunder continues shall be a fine of not more than five hundred
dollars ($500.00) or imprisonment for not more than ninety (90) days.

No permit may be issued for the construction or operation of
a used car dealership, sales facility or storage facility unless and
until the applicant has submitted satisfactory evidence to the Building
Commissioner and to the City Clerk of the applicant's compliance with
all applicable State and Federal licensing and regulatory laws including,
but not limited to, the presentation by the applicant of a Missouri
sales tax registration and number.

Nothing herein shall be construed to eliminate the necessity
for the owner or proprietor of a used car dealership, sales facility
or storage facility to obtain a merchant's license or business license
in accordance with the applicable ordinances therefor of the City
of Breckenridge Hills.
