A. 
There is hereby established within the office of the Mayor the Department of Economic and Community Development, which shall consist of two divisions: Community Development and Economic Development.
B. 
The Mayor shall nominate, subject to appointment by the Municipal Council, an Executive Director of the Department of Economic and Community Development who shall serve for a term of three years.
C. 
The Executive Director shall nominate a Director of Community Development and a Director of Economic Development; said nominations are subject to approval by the Mayor and confirmation by the Municipal Council. Upon said nomination, approval and confirmation, each shall serve for a term of five years.
A. 
Executive Director of Economic and Community Development.
(1) 
The qualifications, duties and responsibilities of the position are those that may from time to time be established by the Mayor. Notwithstanding this provision, the Executive Director shall have a bachelor's degree in economics, marketing, planning, public or business administration or related field and five years of increasingly responsible work experience in any combination of public or private business, real estate or economic development, including a minimum of two years managing complex projects.
(2) 
The Executive Director shall have general powers of superintendence over the Department and all of its employees, including but not limited to the directors of the respective divisions within the Department.
B. 
Community Development Director.
(1) 
The qualifications, duties and responsibilities of the position are those that may from time to time be established and agreed upon pursuant to negotiations between the City of Taunton and the City of Taunton Management Association.
(2) 
The Director shall have general powers of superintendence over the division and all of its employees, subject to the approval and oversight of the Executive Director of the Department.
C. 
Economic Development Director.
(1) 
The qualifications, duties and responsibilities of the position are those that may from time to time be established and agreed upon pursuant to negotiations between the City of Taunton and the City of Taunton Management Association.
(2) 
The Director shall have general powers of superintendence over the division and all of its employees, subject to the approval and oversight of the Executive Director of the Department.
The salary of the Executive Director shall be as determined by appropriation and contract with the City of Taunton. In addition, the working conditions and other benefits of the Executive Director shall be established by contract with the City of Taunton. The Community Development Director and the Economic Development Director and the Department staff shall be compensated as negotiated by the Mayor with the City of Taunton Management Association (COTMA) and with Public Employees Union Local 1144, or with other collective bargaining units as may be appropriate and approved by the Municipal Council, relative to wages, hours, working conditions and other benefits. Staff and personnel shall not be governed under civil service provisions without the express approval of the Mayor and the Municipal Council.
A. 
The staff of the Department shall be determined according to the needs of the Department as established by the Executive Director. Said staffing levels and positions shall be subject to the approval of the Mayor and Municipal Council pursuant to the municipal budget process.
B. 
If there is a permanent vacancy in the position of Executive Director, that vacancy shall be filled as provided above for the nomination and appointment of the Executive Director. If there is a permanent vacancy for either director of a division, the position shall be filled pursuant to the provisions of the applicable collective bargaining provision between the City of Taunton and the City of Taunton Management Association.
C. 
In the event that there is a temporary vacancy in the position of the Executive Director (and directors of divisions), or there is an absence due to illness or vacation of the Executive Director and any director, the Mayor may designate a municipal agency manager, who shall discharge the duties of the director during the vacancy.
