Pursuant to the authority vested in the Quincy City Council and the Mayor by MGL c. 130, § 52, as amended, and by MGL c. 130, § 75, as amended, we, the City Council and the Mayor, make and promulgate the following regulations relative to shellfish and seaworms within the City.
A. 
Shellfish and seaworms may be taken only during the time between one hour before sunrise and one hour after sunset during the months of April, May, June, July, August, September and October, and during the months of November, December, January, February and March, shellfish and seaworms may be taken only between the hours of 6:00 a.m. and 6:00 p.m.
B. 
In any area determined under MGL c. 130, § 74, to be contaminated, shellfish shall not be taken earlier than one hour before sunrise nor loaded into trucks for transport later than 1/2 hour after sunset. In all such areas, the provisions of the Shellfish Management and Regulation Plan for the City, together with the provisions of this chapter, are applicable.
During the months of May, June, July, August and September, no shellfish or seaworms may be dug or taken within 150 feet of high-water mark.
Only tined clam hoes or forks shall be used in taking shellfish and seaworms by any holder of a permit issued as provided by this chapter.
