There is hereby established within and for the City a Planning
and Zoning Commission which shall consist of not more than fifteen
(15) nor less than seven (7) members, including the Mayor, if the
Mayor chooses to be a member; a member of the Board of Aldermen selected
by the Board, if the Board chooses to have a member serve on the Commission;
and not more than fifteen (15) nor less than five (5) citizens appointed
by the Mayor and approved by the Board of Aldermen. The term of each
of the citizen members shall be for four (4) years, except that the
terms of the citizen members first appointed shall be for varying
periods so that succeeding terms will be staggered. Any vacancy in
a membership shall be filled for the unexpired term by appointment
as aforesaid. The Board of Aldermen may remove any citizen member
for cause stated in writing and after public hearing.

All citizen members of the Planning and Zoning Commission shall
serve without compensation and shall hold no other municipal office.
The Commission shall elect its Chairman and Secretary from among
the citizen members. The term of Chairman and Secretary shall be for
one (1) year with eligibility for reelection. The Commission shall
hold regular meetings and special meetings as they provided by rule,
and shall adopt rules for the transaction of business and keep a record
of its proceedings. These records shall be public records. The Commission
shall appoint the employees and staff necessary for its work, and
may contract with City planners and other professional persons for
the services that it requires. The expenditures of the Commission,
exclusive of grants and gifts, shall be within the amounts appropriated
for the purpose by the Board of Aldermen.

The Board may provide the funds, equipment and accommodations
necessary for the work of the Commission, but the expenditures of
the Commission, exclusive of gifts, shall be within the amounts appropriated
for that purpose by the Board and no expenditures, nor agreements
for expenditures, shall be valid or legal in excess of such amount.
Provided however, that such Commission shall have the authority and
power to accept and receive donations of cash or property, gifts,
bequests and grants and, with the approval of the Board, may use such
non-appropriated assets as the Commission shall deem beneficial and
advantageous to the City of Leadwood.
All public officials shall upon request furnish to the Planning
and Zoning Commission, within a reasonable time, all available information
it requires for its works.
In general, the Planning and Zoning Commission shall have the
power necessary to enable it to perform its functions and promote
City planning. The Planning and Zoning Commission shall have the power
to perform all of the functions of the Zoning Commission provided
for in Chapter 89, RSMo., and shall have and perform all of the functions
of a Planning Board as outlined in such Chapter.

The City of Leadwood shall be authorized to make, adopt and
extend and carry out a municipal plan as authorized by laws.

A. It
shall be the function and duty of the Commission to make and adopt
plans for the physical development of the municipality, including
any areas outside of its boundaries but within its Statute authority
which, in the Commission's judgment, bear relation to the planning
of the municipality.
B. The
Commission, from time to time, shall recommend to the appropriate
public official programs for public structures and improvements and
for the financing thereof. It shall be the function and duty of the
Commission to further consult and advise with public officials and
agencies, civic organizations, public utility companies, educational,
professional and other organizations, and with citizens with relation
to the promulgation and carrying out of the plan. The Commission shall
have the power to delegate authority to any of the above-named groups
to conduct studies and make surveys for said Commission if it deems
expedient.
