A. 
In accordance with the guidelines, standards and specifications set forth herein, the Superintendent of Streets, working with and at the direction of the Traffic Engineer or his/her designee, may provide for the establishment of a restricted parking area along North High Street in the City for the purpose of encouraging and making available parking for customers of business proprietors.
B. 
Limited parking zone(s) may be established pursuant to the following:
1. 
The owner or general agent of the building or premises in which the business is located may request, in writing, that a limited parking zone be established for the purpose of permitting parking in front of the business for customers of the proprietorship.
2. 
Each business shall be permitted such limited parking space in front of the establishment, along the length of the business front, in the discretion of the Superintendent, not to exceed the following schedule:
a. 
Commercial retail sales. One (1) parking space for every one hundred fifty (150) square feet.
b. 
Commercial service, including banks. One (1) parking space for every three hundred (300) feet.
c. 
Commercial wholesale, excluding warehouse facilities. One (1) parking space for every three hundred (300) square feet.
d. 
Dance halls, beer gardens and all other similar recreational activities and buildings. One (1) parking space per one hundred (100) square feet.
e. 
Restaurants. One (1) parking space for every one hundred (100) square feet.
For any and all uses or structures not specifically provided for in the foregoing listing, such parking space as the Superintendent shall determine necessary, considering all of the parking generating factors involved.
C. 
Parking shall be restricted, in accordance with this Section, to the following schedule: Two (2) hour parking.
D. 
All limited parking areas shall be marked with appropriate signage.
E. 
Adjoining property owners may request the termination of the parking restrictions, and the Superintendent shall terminate the same, if in his/her discretion, it is determined that the benefits of the restricted parking zone are outweighed by the negative impact(s) upon adjoining property owners or safety issues. The Superintendent may also terminate the restricted parking at any time if, in his/her discretion, he/she believes it to be in the best interest of the City to do so.
F. 
If any vehicle is found in violation of this provision and the driver thereof is not present, the owner or person in whose name such vehicle is registered in the records of the City, County or State shall be responsible for such violation when such vehicle was being used with permission. Proof of the ownership, as aforesaid, shall be prima facie evidence that such vehicle with absent driver was being operated with the permission of the owner. Owners and operators of vehicles parked in violation of this Schedule shall be deemed guilty of improper parking, and such offense is punishable pursuant to Section 100.040.
