A. "Modular home" means a dwelling intended for, constructed
for, and used entirely for residential purposes, but not hotels or
motels, and which must meet the following minimum standards:
1. The structure must have a gable or hip roof pitch of no less than
three (3) inches of vertical rise to every twelve (12) inches of horizontal
run.
2. The structure must have a minimum width of twenty-four (24) feet
as measured at all points perpendicular to the length of the modular
home which cannot have more than two (2) parts, i.e. two (2) halves,
and which parts are constructed to be permanently affixed one to the
other. This language shall not be construed to include a double-wide
mobile home as a modular home.
3. The structure must have had all axles, running gears, lights and
towing apparatus permanently removed.
4. The structure must have siding material consisting of wood or wood
products, stucco, brick, rock, horizontal or vertical steel, aluminum
or vinyl. Roofing material must consist of composition asphalt shingles,
fiberglass shingles, woodshakes or baked tiles. Roof area must have
a projecting eave with an overhang of at least one (1) foot measured
from the vertical side of the modular home. When attached carports,
garages, porches or similar structures are an integral part of the
home, this overhang or projecting eave requirement may be waived (when
the accessory structure is attached to the home). All roof structures
must have an eave project.
5. The structure must have proper guttering attached to all roof eave
projections.
The term "modular home" does not include mobile
homes, trailers or house trailers, or any similar structure which
is not constructed for an intended permanent placement.

Modular homes which meet the requirements of Section
412.010 of this Chapter may be located or permanently placed on a residential lot in the City of California, Missouri, as long as the siting requirements set forth below are met.

A. Each
modular home placed on a residential lot shall meet the following
requirements:
1. Be occupied only as a single-family dwelling.
2. Be placed in accordance with any setback requirements then existing
in the City.
3. The modular home must have been manufactured within two (2) years
prior to the date of placement of the same.
4. Only one (1) modular home may be located on any one (1) residential
lot.
5. Modular home shall be attached to a permanent perimeter foundation
which must be properly engineered and enclosed. The foundation must
meet all manufacturer's specifications for support with a vapor barrier
in place. The owner of the modular home shall be responsible for notification
of the Building Inspector of the construction of the foundation and
the Building Inspector provided opportunity to inspect the foundation
in advance of placement of the modular home thereon. The foundation
material shall consist of continuous concrete, brick, flagstone, poured
concrete or masonry suitable for the outer portion of a finished residence.
The foundation and facade shall have permanently installed venting;
deletion or omission of venting is not allowed. Minimum crawl space
shall be eighteen (18) inches under the entire modular home.
6. The modular home shall have permanent steps set at all entrance/exits
to the modular home.

A. Each
module home approved for placement on a parcel shall be subject to
the following inspections:
1. Foundation inspection. A foundation inspection prior
to placement of the manufactured home shall be required to check the
foundation's construction, placement of vapor barrier, depth of crawl
space and proposed vent placement.
2. Foundation anchors and utility connections or landings.
3. Temporary or permanent steps at all doors prior to occupancy. Permanent
steps shall be placed within ninety (90) days of occupancy. "Permanent steps" shall be defined as a means of egress
that is anchored or permanently attached to the ground.
4. A final inspection shall be permitted prior to permanent occupancy.
Final approval to occupy the dwelling shall not occur until the final
inspection is complete or final inspection is waived. Failure to receive
a final inspection unless waived is a per se violation of this Section
subject to a fine and such other remedies and options available to
the City as set forth below.
5. The owner shall give the Building Inspector notice when the premises
are ready for inspection and shall not proceed further until approval
has been given by the official pursuant to each inspection or inspection
has been waived in writing.
6. City inspection shall not be required of City but is permitted upon
notification to property owner.
7. City shall not assume, by virtue of a failure to inspect or by virtue
of an inspection, any liability for errors or omissions in construction
or placement of the home or construction of the foundation.
8. The City is not required to inspect the premises foundation or modular
structure prior to placement or at the time of placement. Any violation
of the ordinance is not waived or permitted on the basis of an inspection
or failure to inspect.

All legal existing occupied modular and/or manufactured homes
located on an individual lot shall be permitted to remain in place
so long as occupied, but provided that they may not be replaced unless
made to conform with the requirements of this Section. Any such existing
modular and/or manufactured home shall be removed when unoccupied
for a period in excess of six (6) months.

Violators of this Section shall be subject to penalties for
violation of a fine of not less than one dollar ($1.00) nor more than
five hundred dollars ($500.00) per violation. Each day of continuing
violation shall be considered a separate offense. In the event of
non-conformity with any part, provision or term of this Chapter, the
City may decline to provide certain services to the property or may
discontinue or terminate provision of certain services to the property
including, but not limited to, water, electricity, gas, trash and
sewer. Further, upon violation or failure to conform with the requirements
of this Chapter, the City may, at its option, prohibit the placement
of the structure or require its removal at cost of owner.

A modular home sited pursuant to this Chapter shall be declared
by owner as real property and taxed accordingly both in the City of
California, Missouri, and Moniteau County, Missouri.
