All persons, associations, corporations, partnerships or any
other person legally or otherwise that uses electricity supplied by
the City of California, Missouri, shall have an electric meter to
register the amount of electricity used. This meter shall be furnished
and maintained by the City of California, Missouri, in accordance
with the ordinances of the City of California, Missouri, and the Statutes
of the State of Missouri.

The location of the electric meter used to register the amount
of electricity used by a customer, whether a person, association,
corporation, partnership or any other person legally or otherwise
that uses electricity supplied by the City of California, Missouri,
shall be at the discretion of the Department of Utilities of the City
of California, Missouri.

The cost of maintenance of all lines, poles and fixtures of
whatever type used to convey or transmit electricity from that point
where the electric meter is located to the customer's home or business
is the responsibility of said customer.

A. The
City of California hereby undertakes to comply with all lawful regulations
of the FERC codified in Subpart C of 18 CFR Part 292 dealing with
arrangements with qualifying cogeneration and small power production
facilities under Section 210 of PURPA.
B. The
City Clerk and the City Attorney are jointly and severally authorized
and directed to file with the FERC a copy of this Article reflecting
the City's compliance with 18 CFR Section 292.401(c).
C. The
City Clerk is hereby directed to certify the passage of this Article
by publishing the same or causing the same to published in the City's
commonly accepted publication of news items. Additionally, the City
Clerk is directed to post a notice of this Ordinance on any and all
public bulletin boards where official notice of the City's Governing
Body's activities are normally posted.
