Pursuant to Section 11 of the Uniform Fire Safety Act. (P.L.
1983, c. 383), the New Jersey Uniform Fire Code shall be locally enforced
within the Township of Mount Olive.

The local enforcing agency shall be the Bureau of Fire Prevention,
which shall be under the supervision of the Township Fire Marshal,
who shall be the Fire Official.
The local enforcing agency shall enforce the Uniform Fire Safety
Act and the codes and regulations adopted under it in all
buildings, structures and premises within the established boundaries
of the Township of Mount Olive, other than owner-occupied one- and
two-family dwellings, and shall faithfully comply with the requirements
of the Uniform Fire Safety Act and the Uniform Fire Code.
The local enforcing agency established by §
201-2 of this chapter shall carry out the periodic inspections of life-hazard uses required by the Uniform Fire Code on behalf of the Commissioner of Community Affairs.
The local enforcing agency established by §
201-2 of this chapter shall be part of the Division of Fire and Rescue Operations and Inspections within the Department of Fire and Emergency Management of the Township of Mount Olive.
Pursuant to Sections 15 and 17 of the Uniform Fire Safety Act, any person aggrieved by any order of the local enforcing
agency shall have the right to appeal to the Construction Board of
Appeals of Morris County.

In addition to the inspections and fees required pursuant to
the Act and the regulations of the Department of Community Affairs,
the following additional inspections and fees shall be required:
A. Additional required inspections.
(1) All places of business not required to be registered as a life-hazard
use shall be scheduled for inspection every 12 months.
(2) All storage or activities requiring a permit shall be scheduled for
inspection every 12 months or when deemed necessary by the Fire Marshal
prior to or during an activity requiring a permit.
B. Additional required fees.
(1) All buildings and structures, other than those classified as Use
Group R-3, which are not required to be registered as life-hazard
uses must be registered with the Bureau of Fire Prevention and shall
be subject to an annual registration fee of $100.
(2) All building uses or businesses, other than those classified as Use
Group R-3, which are not required to be registered as life-hazard
uses must be registered with the Bureau of Fire Prevention and shall
be subject to an annual registration fee of $100.
(3) Exception. Buildings or structures that are occupied by a single
building use or business that is owned and operated by the building's
or structure's owner shall not be required to register the building
use nor business in addition to the registration of the building or
structure.

A. Permits as per the New Jersey Uniform Fire Code. The fee for permits
required to be issued under the New Jersey Uniform Fire Code shall
be as provided in the code set forth in N.J.A.C. 5:70-2.9.

The following articles or sections of the State Fire Prevention
Code, N.J.A.C. 5:70, are modified as follows:
A. The following amendments are made to N.J.A.C. 5:70-1.5, Definitions:
(1) The term "Chief of the Fire Department" shall be added and have the
following meaning: the Chief of the Budd Lake Fire Department and
the Chief of Flanders Fire Company No. 1.
B. The following new section, N.J.A.C. 5:70-3.2(a)36, F-3610.6, Storage
of liquefied petroleum gases in or near multifamily buildings, is
added:
5:70-3.2(a)36, F-3610.6, Storage of liquefied petroleum
gases in or near multifamily buildings. The storage of liquid
petroleum gas containers larger than 2 1/2 pounds' water capacity
(nominal one pound liquid petroleum gas capacity) is hereby prohibited
within five feet of any multifamily dwelling building.

A. Definitions. As used in this section, the following terms shall have
the meanings indicated:
FIRE WATCH
A temporary measure ordered by the Township Fire Marshal
to provide continuous and systematic surveillance of, and response
to, the Township or a portion thereof, or a building or portion thereof,
by one or more qualified individuals, for the purpose of identifying
and controlling fire and other life/property hazards, detecting early
signs of an unwanted fire, raising an alarm of fire to the occupants,
notifying the appropriate Fire Department, and engaging in firefighting
or other emergency response.
B. Initiation; scope; liability for costs.
(1) Requests for a fire watch shall be made in writing to the Township
Fire Marshal unless deemed emergent by the Fire Marshal.
(2) The Fire Marshal or designee may order a fire watch in any portion
of the Township in public and privately owned buildings and/or properties
for the following circumstances:
(a)
A fire protection system failure or deficiency exists that,
in the opinion of the Fire Marshal, creates an imminent hazard; or
(b)
A pyrotechnics display, to ensure the safety of the public or
emergency responders.
(3) The Fire Marshal, in consultation with the Fire Department(s), shall
determine the number of personnel and fire apparatus required to provide
adequate protection, and the times that the fire watch personnel shall
be on duty.
(4) As the Township may direct, a fire watch shall be paid for by the
Township or by a building owner, tenant, lessee, or organization.
C. Services or requirements during watch. A fire watch may include firefighting,
rescue, recovery, and other emergency responses; the maintaining of
posted fire lanes, means of egress, and posted occupancy loads; enforcement
of no smoking in posted areas; area and building surveillance; checking
for proper permits; inspecting for proper safety precautions of cooking
equipment; and such other functions as required by the Fire Marshal
or designee.
D. Individuals authorized to perform watch.
(1) Fire Prevention shall create a list of individuals authorized pursuant
to N.J.A.C. 5:73-1.1 et seq. to perform a fire watch and available
to the Township. Other personnel may be approved to serve on the fire
watch team at the discretion of the Fire Marshal.
(2) Each member of the fire watch team shall be properly identified.
(3) Fire watch team members shall report directly to the Fire Marshal
or designee and be dedicated to the fire watch.
(4) Persons on the fire watch list shall be Mount Olive Fire Prevention
inspectors and/or volunteer members of the Flanders Fire Company or
Budd Lake Fire Department who are certified firefighters (Firefighter
1).
E. Rates and payments.
(1) The rates to be charged for Mount Olive Fire Prevention inspector
services shall be determined annually, as established in the Salary
Ordinance, and shall include an administrative fee fixed by the Township.
(2) The rates to be charged for services provided by volunteer members
of the Flanders Fire Company and Budd Lake Fire Department shall be
at the rate of $25/hour per person.
(3) The rates to be charged for each piece of fire apparatus deemed necessary
by the Township shall be at a rate of $20/hour per apparatus.
(4) Fire watch services must be requested through the Fire Prevention
Department on a form prescribed by the Fire Marshal, and payment must
be made at the time of the application. No work will be scheduled
until sufficient funds are posted in an established escrow account.
(5) Payments shall be made payable to Mount Olive Township, the Budd
Lake Fire Department, or the Flanders Fire Department, as applicable
and subject to available personnel.
(6) No Township-owned building or Township-organized event requiring
a fire watch shall be charged a fire watch fee.
