Budd Lake, located within the Township of Mount Olive, as a
natural body of water available for the recreational needs of the
community, constitutes a natural resource worthy of maintenance. The
dam located at the western edge of the lake governs the flow of water
in the South Branch of the Raritan River. Fluctuations in the height
of the waters of Budd Lake could and do result in flooding conditions
downstream along the South Branch of the Raritan River. In order to
control such fluctuations, this article is adopted to regulate the
flow of waters over the dam and to create the position of Dam Manager
who shall be responsible for controlling the weirs of the Budd Lake
Dam in accordance with the regulations of this article.
There is hereby created the position of Budd Lake Dam Manager.
The Manager shall be the Public Works Coordinator of the Township
of Mount Olive and shall serve with no additional compensation.
A.
The Dam Manager shall be responsible for maintaining the weirs at the Budd Lake Dam at an elevation of 933.64 feet, more or less, unless otherwise modified as set forth in § 158-4 below.
B.
For the purpose of determining elevation of the south wing, the wall
adjacent to stop logs (weirs) has an elevation of 935.77 feet as determined
by a January 29, 1974, survey by the Department of Transportation.
This elevation shall be used as a reference.
A.
The weir boards of the Budd Lake Dam shall be maintained at a maximum
elevation of 933.64 feet, more or less. This elevation shall be taken
at the top of the weir, when the weirs are in place at the Budd Lake
Dam. This maximum elevation shall be required at all times, except
that a minimum elevation of 932.77 feet may be permitted during the
period of October 15 through April 15 of the following year to permit
a lowering of the lake during the winter period.
B.
The Manager shall notify and obtain permission from the New Jersey
Division of Fish, Game and Shell Fisheries for the installation or
removal of the weir boards in accordance with N.J.S.A. 23:5-29.
C.
The Manager shall seek permission from the Division of Fish, Game
and Shell Fisheries and may hereafter raise and lower the weir boards
in accordance with this article and the New Jersey State regulations.
D.
In cases of absolute emergency threatening the dam or the public
safety of the residents of Mount Olive Township, the Manager shall
be permitted to raise or lower the weir boards.
Any unauthorized person, firm or corporation found tampering
with the Budd Lake Dam shall, upon conviction thereof, be punishable
by one or more of the following: by imprisonment for a term not exceeding
90 days or by a fine not exceeding $1,000 or by a period of community
service not exceeding 90 days.
