The Borough Council hereby signifies its intention and desire to organize an authority under the provisions of the "Municipality Authorities Act of 1935," as amended.[1]

The Mayor, the President of the Borough Council and the Secretary are hereby authorized and directed to execute on behalf of the Borough of Littlestown, Articles of Incorporation for said Authority, in substantially the following form:

In compliance with the requirements of the Act of June 28, 1935, P.L. 463, known as the "Municipality Authorities Act of 1935," as amended, the Borough of Littlestown, Adams County, Pennsylvania, desiring to incorporate an Authority thereunder, does hereby certify:
A.
The name of the "Authority" is "Littlestown Borough Authority."
B.
Said Authority is formed under the provisions of the Act of June 28, 1935, P.L. 463, as amended.
C.
No other Authority organized under said Act of June 28, 1935, P.L. 463, as amended, or under the Act of December 27, 1933 (Special Session, 1933, P.L. 114), is in existence in or for the incorporating municipality, the Borough of Littlestown.
D.
The name of the incorporating municipality is Borough of Littlestown, Adams County, Pennsylvania, and the names and addresses of its municipal authorities are as follows:

Mayor Evan M. Appler, 215 North Queen Street, Littlestown, Pennsylvania.
2.
President of Council Howard T. Wherley, 127 North Queen Street, Littlestown, Pennsylvania.
3.
Secretary of Council Roger J. Keefer, 32 North Queen Street, Littlestown, Pennsylvania.
4.
Borough Treasurer John H. Flickinger, 202 North Queen Street, Littlestown, Pennsylvania.
5.
Councilman Charles R. Mehring, 25 West Myrtle Street, Littlestown, Pennsylvania.
6.
Councilman Albert H. Kindig, 132 West King Street, Littlestown, Pennsylvania.
7.
Councilman S. M. Keagy, 116 East King Street, Littlestown, Pennsylvania.
8.
Councilman George W. Basehoar, 31 West King Street, Littlestown, Pennsylvania.
9.
Councilman Claude A. Snyder, 65 Crouse Park, Littlestown, Pennsylvania.

The names, addresses and terms of office of the first members of the Board of said Authority are as follows:

George W. Basehoar, Littlestown, Pennsylvania, one year.

Charles R. Mehring, Littlestown, Pennsylvania, two years.
3.
S. M. Keagy, Littlestown, Pennsylvania, three years.
4.
Samuel E. Renner, Littlestown, Pennsylvania, four years.
5.
Arthur E. Bair, Littlestown, Pennsylvania, five years.
F.
The term of existence of said Littlestown Borough Authority, of Adams County, Pennsylvania, shall be for a period ending June 22, 2037.

G.
In conjunction with all other rights, powers and authority granted unto this Authority by the "Municipality Authorities Act of 1945", as amended [53 P.S. 301 et seq.],[1] this Authority shall have the power and authority to participate in the financing of projects of worthy, nonprofit charitable and/or educational entities through its issuance of tax-exempt obligations, and, upon approval by the Authority of any such financing, to authorize its appropriate officers to execute, acknowledge, attest and deliver any and all necessary or appropriate documents and take any and all necessary or appropriate actions in connection with such duly authorized and approved financing.

The proper officers of the Borough are hereby directed to cause a notice of this ordinance to be published one time in the Adams County Independent, a newspaper published and of general circulation in the County of Adams, and to cause a proper notice to be published of the intention to file the Articles of Incorporation with the Secretary of State of the Commonwealth of Pennsylvania, as directed by the Act of June 28, 1935, P.L. 463, as amended.
The Mayor, President of Borough Council and the Secretary are directed to file said Articles of Incorporation, together with the necessary proofs of publication, with the Secretary of the Commonwealth, and to do all other acts and things necessary or appropriate to effect the incorporation of the Littlestown Borough Authority.
The project which shall be undertaken by the said Authority is to acquire, hold, construct, improve, maintain, operate, own, lease, either as lessor or as lessee, sewers, sewer systems or parts thereof and sewage treatment works for the Borough of Littlestown and for such other territory as it may be authorized to serve.
