The purpose of this article is to establish a registry of commercial and residential rental units within the Borough of Littlestown and to aid in the administration of Chapter 500, Zoning, by establishing from such registry a listing of nonconforming uses of that character as required by § 500-32 of said Chapter 500, Zoning; to aid in the assessment of proper rental in connection with public sewer and water connections; to aid in maintaining the tax rolls of the Borough; and to aid the Borough in its overall planning and governmental functions.
As used in this article, the following terms shall have the meanings indicated:
BOROUGH
The Borough of Littlestown, Adams County, Pennsylvania.
LESSEE
Any person who has the use of the real estate of another under a written or oral lease agreement in return for any type of consideration, excluding "lessees" for a period of less than 30 days.
LESSOR
A person who grants a lease or otherwise permits the use of his/her/its real estate or portion thereof by another for a consideration, monetary or otherwise.
PERSON
A natural person, 18 years of age or older, partnership, association, firm or corporation.
RENTAL FACILITIES
Includes but is not limited to, all single-family dwelling units, multiple-family units, apartments, townhouses and commercial units.
All lessors, within 60 days after the effective date of this article, or in case of real estate thereafter acquired or thereafter rented or becoming available for rental, within 30 days after the acquisition, rental or availability for rental thereof, as the case may be, shall submit to the Borough in writing a list of occupants, consisting of the names and apartment numbers/addresses of all persons residing or occupying said unit for residential or commercial purposes.
Any change in the occupancy of real estate rented or leased or in the identity of the lessee(s) from that shown in the report of the lessor required in § 348-3 hereof shall be reported in writing by the lessor to the Borough within 10 days after such change. It is intended hereby that lessors shall report a new lessee(s) or a lessee(s) who rents or leases a different unit or parcel of lessor's real estate, as well as when a unit or parcel of said lessor's real estate becomes vacant.
The Borough may prepare a form report, entitled "Status of Occupancy Report," which form report may require the information set forth above and such other pertinent information as the Borough Council of the Borough of Littlestown by resolution may direct the lessor to incorporate into said report. The failure to have such report forms, however, shall not excuse the obligation of lessors to provide the information required herein.
Any lessor violating any of the provisions of this article, or who furnishes false information to the Borough, or who uses a false name or address in any report required by this article, shall, upon conviction thereof in a summary proceeding before a Magisterial District Judge, be punished by a fine of not more than $300, plus costs of prosecution for each offense, and upon default in payment of the fine and/or costs, by imprisonment in the Adams County Prison for a period not to exceed 30 days.
This article shall become effective the 27th day of August 1990.
