The intent of this article is to provide safe and healthful
conditions for the enjoyment of aquatic travel and recreation consistent
with public rights and interest and the capability of the water resources.
The provisions of this article shall apply to those portions
of the waters of Lake Butte des Morts hereinafter designated within
the jurisdiction of the Town of Algoma. The provisions of this article
shall be enforced as provided in Wisconsin Statutes applicable under
§§ 30.66, 30.68, 30.74, 30.745, and 30.77 by any law
enforcement officer as defined under § 23.51(3) or 939.22(22),
Wis. Stats. The primary law enforcement agency shall be the Winnebago
County Sheriff's Department which shall respond to complaints directed
to that Department.
In this article, the following terms shall have the meanings
indicated:
BOAT
Every description of watercraft used or capable of being
used as a means of transportation on water.
MOTORBOAT
Any boat equipped with propulsion machinery, whether or not
the machinery is the principal source of propulsion.
OPERATOR
A person who is engaged in the operation of a motorboat,
who is responsible for the operation of a motorboat, or supervising
the operation of a motorboat.
SLOW-NO-WAKE
That speed at which the boat moves as slowly as possible
while maintaining steerage control.
WATERS OF STEINHILBER MARSH
Any waters, navigable tributaries and channels of Lake Butte
des Morts within the area of Town of Algoma, T.18N.-R.16E. SE 1/4
Sec 9 and NE 1/4 Sec 16 bound on the east by US Highway 41, on the
south and west by shoreline and on the north by a line between the
northeast most point of Moore Island east to US Highway 41 and including
all navigable channels from said marsh southerly into the SE 1/4 of
the SE 1/4 and the NE 1/4 of the NE 1/4 of Sec 18, Township 16 N,
Range 16 East.
No person shall operate a motorboat on the waters of Steinhilber
Marsh in the Town of Algoma at a speed in excess of slow-no-wake.
The proper Town officials are authorized to place, or cause
to be placed, the appropriate signs and navigational aids and buoys
to mark the locations of the speed limit restrictions of this article.
Wisconsin state boating penalties as found in § 30.80,
Wis. Stats., are adopted by reference.
This article shall be effective upon passage, approval by the
Wisconsin Department of Natural Resources and publication in the Oshkosh
Northwestern.

30.77 by any law enforcement officer as defined under § 23.51(3)
or 939.22(22), Wis. Stats. The primary law enforcement agency shall
be the Winnebago County Sheriff's office which shall respond to complaints

FOX RIVER CHANNEL UNDER US 41 BRIDGE
All waters of Lake Butte des Morts lying beneath the main
span of the US Highway 41 bridge between the causeways on the north
and south and the easterly and westerly extremities of the bridge
structure carrying both the north- and southbound lanes of the highway.
It is through this span that the channel of the Fox River flows and
it is this span which is marked for navigation.

who is responsible for the operation of a motorboat, or supervising
the operation of a motorboat.

No person shall operate a motorboat on such portion of the Fox
River Channel under the US Highway 41 bridge at a speed in excess
of slow-no-wake.
