There are occasions when a duly appointed member of the South Nyack Planning Board or Zoning Board of Appeals cannot attend a meeting of said board or, because of a conflict of interest, cannot vote on a matter to be considered by said board, resulting in a lack of a quorum for the conduct of business. It is the purpose of this article to permit the Mayor to appoint an ad hoc member to attend such meeting and to vote in place of such absent or disqualified member.
The Board of Trustees shall prepare a list of persons who are residents of the Village of South Nyack and who are eligible for appointment to Village office, as set forth in § 3-300 of the Village Law. Persons on said list may be called upon to act as ad hoc members of the Planning Board or the Zoning Board of Appeals. This list shall consist of a minimum of three persons and shall be amended, revised, increased or decreased by the Board of Trustees in the discretion of said Board.
The Mayor of the Village of South Nyack is hereby authorized to appoint one or more ad hoc members to the Planning Board or the Zoning Board of Appeals, subject to the following conditions:
A. 
One or more duly appointed members of any of the aforesaid boards shall advise the Mayor, prior to a meeting of the board, that he/she will not be able to attend said meeting or will not be able to vote on a matter that is scheduled to be heard by said board because of a conflict of interest in connection with the applicant;
B. 
The affected board will not be able to meet or make a decision on an application before it for lack of a quorum caused by the failure of one or more members to attend and/or to vote; and
C. 
The Mayor shall appoint said ad hoc member or members from the list prepared by the Board of Trustees, as set forth in § 16-2 hereinabove.

A. 
The term of appointment of an ad hoc member appointed as set forth hereinabove shall be for the specific meeting of the respective board for which he/she has been appointed.
B. 
The list of persons named as ad hoc members by the Board of Trustees shall remain in effect for one official year.
An ad hoc member of a board appointed by the Mayor pursuant to this article shall have all of the powers and duties of the duly appointed member that he/she is replacing for the meeting for which he/she has been appointed.
