As used in this article, the following terms shall have the
meanings indicated:
BUILDING DRAIN
That part of the lowest horizontal piping of a drainage system
which receives the sewage or discharge from soil, waste and other
drainage pipes inside the walls of the building and conveys it to
the building sewer, beginning five feet outside the inner face of
the building wall.
BUILDING SEWER
The extension from the building drain to the public sewer
or other place of disposal.
INSPECTOR
The person appointed by the Borough of Glen Osborne to inspect
building sewers and all other connections between occupied homes and
other buildings and the public sewers.
NATURAL OUTLET
Any outlet directly or indirectly into a watercourse, pond,
gutter, ditch, lake or other body of surface or ground water.
PERSON
Any individual, firm, company, association, society, corporation
or group.
PUBLIC SANITARY SEWER
A sanitary sewer which has been constructed and is owned
by the Borough of Glen Osborne or has been constructed by private
parties and has been accepted by the Borough of Glen Osborne as a
sanitary sewer.
PUBLIC SEWER
A sewer in which all owners of abutting properties have equal
rights and which is controlled by public authority.
SANITARY SEWER
A sewer which carries sewage and to which storm-, surface
and ground waters are not intentionally admitted.
SEMIPUBLIC SANITARY SEWER
A sanitary sewer constructed and laid by a developer in accordance
with the rules and regulations of the Borough of Glen Osborne relating
to sewers, with the intent that the said sanitary sewer shall eventually
become a part of the public sewer system, but the responsibility for
laying, construction and maintenance of said sanitary sewer and the
disposal of sewage therefrom still remains with the developer or other
private persons.
SEWAGE
The water-carried wastes from the residences, apartments,
business and commercial buildings and institutions.
SEWER
A pipe or conduit for carrying sewage.

A. From and after the date of the passage of this article, the owners
of all improved properties within the Borough of Glen Osborne, abutting
a sanitary sewer of Glen Osborne, must connect the sewage facilities
of each such property to said public sanitary sewers of Glen Osborne
after the payment to Glen Osborne of a tap-in fee of $700 for each
house or dwelling unit, and any other method or manner of disposing
of acceptable sewage wastes from such properties will not hereafter
be permitted.
B. Pursuant to 53 P.S. § 47053, a tapping fee shall be charged
whenever the owner of property connects such property with a sanitary
sewer system constructed or acquired by the Borough of Glen Osborne.
Said tapping fee shall be in the amount of $700 per dwelling unit
connected and shall be in addition to any charges assessed and collected
against such property in the construction or acquisition of such sanitary
sewer by the Borough of Glen Osborne. The tapping fee shall be payable
at the time of tapping in, except that the fee may be collected at
the time of application for the building permit in the case of a new
house or dwelling unit.
No person shall maliciously, willfully or negligently break,
damage, destroy, deface or tamper with any structure, appurtenance
or equipment which is a part of the Borough of Glen Osborne sewage
collection system. Any person violating this provision shall be subject
to immediate arrest under charge of disorderly conduct.
The Inspector and duly authorized employees of the Borough of
Glen Osborne, bearing proper credentials and identification, shall
be permitted to enter upon all properties at reasonable times for
the purposes of inspection to carry out the intent of this article.
From and after the date of the passage of this article, any
sewer to be constructed by any person within the Borough of Glen Osborne
to serve either presently improved properties or properties which
are to be developed must be constructed, installed, laid or used in
accordance with the rules and regulations of the Borough of Glen Osborne
which the Council of the Borough of Glen Osborne shall from time to
time by resolution promulgate and put into force.
The Council of the Borough of Glen Osborne is hereby authorized
and empowered from time to time by resolution to promulgate, establish
and set forth in full the rules and regulations relating to the construction
and laying of the sanitary sewers and setting forth the general specifications
for the construction of the same.

By this article, Glen Osborne hereby authorizes the establishment
of sanitary sewage use charges and the utilization of billing and
collecting services for such sewage use. The charges shall be billed
directly to the owners and/or occupants of all developed properties
within Glen Osborne which are connected to public sewage lines. In
order to apportion such sewage charges, the amount of sewerage service
furnished to each user, except as otherwise hereinafter provided,
shall be deemed to be equal to the total amount of water supplied
to such user, shall be expressed in terms of gallons per quarter and
shall be based upon the amount of water consumption metered for each
user by the applicable public water provider.
For the period commencing January 1, 1996, and quarterly thereafter,
all users shall pay directly the charges for sanitary sewerage service
as provided by this article and in accordance with the terms of such
contracts which Glen Osborne may execute to carry out the intentions
of this article. The charges shall be based on the following water
rates and in accordance with the classifications and other provisions
set forth:
A. Quarterly minimum charges. The minimum charge includes 5,000 gallons
of water per quarter per meter.

B. Quarterly consumption charge. In addition to the minimum charge,
the consumption charge is applicable to the excess water consumption
per meter over that included in the minimum charge.

C. Sewage use charge for those not using public water supply. For a
property which uses water from a source other than a public water
supplier, the following rate schedule shall apply:

D. The greater amount shall prevail in calculating quarterly bills by
utilizing the minimum use charge or the itemized rate schedule. (In
making quarterly billings, the minimum charge or the itemized schedule
shall prevail, whichever is the greater sum.)
E. In addition to the charges as set forth above, a capital reserve
charge shall be imposed equal to 25% of the total of all charges.
A sewer use charge, within 30 days after same has been due and
payable, shall be subject to a penalty of 5% and shall be a lien upon
the property charged with the payment thereof from the date said charge
becomes due and payable. Such sewer use charge, if not paid after
30 days' notice, may be collected as provided by law by an action
of assumpsit or by distress of personal property on the premises or
by lien filed in the nature of a municipal lien, together with all
additional rights vested in the authorized collecting agency for collecting
water bills.
