It is the intent of this article to prohibit trash, garbage, debris or hazardous materials from being dumped, or thrown upon, private or public property, and, to prevent the marring or defacement, of said properties.
A. 
Injury to property. No person shall negligently, maliciously, wantonly, or otherwise intentionally remove or mar, cut, mark, or otherwise injure real property or improvements thereto belonging to the Village of Chestnut Ridge or to any person within the Village.
B. 
Scattering of rubbish or other wastes. No person shall transport, throw, drop or place, or permit to be deposited or scattered, upon any sidewalk, alley, street, bridge, or public road or upon any private property, any waste, whether or not classified as trash, garbage, debris, litter, rubbish, fill, or similar materials of any kind, including the abandoning, or stripping and/or junking of vehicles, except as otherwise permitted under law.
C. 
Trespass as separate offense. No person shall trespass upon any public or private property within the Village of Chestnut Ridge with the intent of placing or leaving any wastes thereon. This offense shall be separate and distinct from all other civil, and criminal, trespass offenses.
D. 
Applicability to cemeteries. Commission of the offenses described in any of the sections of this article upon any tomb, monument, grave, bench, tombstone, footstone, headstone, post, marker or other monument for or of the dead, erected or being in any cemetery, now in existence or hereafter created, within the Village of Chestnut Ridge, or upon the lands, grounds or real property of any said cemetery located within the Village of Chestnut Ridge, shall be subject to prosecution in accordance with this article.
A. 
Except as otherwise provided herein, all the terms shall have the meanings heretofore provided in the local laws of the Village. For terms not thereby defined, they shall first have the meanings provided under the New York State Penal, Criminal Procedure (CPL) and Vehicle and Traffic (V&T) statutes. Any word or term not defined as provided in the preceding shall be defined by its ordinary meaning and common usage.
B. 
As used in this article, the following terms shall have the meanings indicated:
WASTES
Includes litter, trash, garbage, debris, rubbish and fill.
The Mayor, any police officer and/or any code enforcement officer, including the Building Inspector, shall have the power, right and authority to issue an appearance ticket for violation of any provision of this article.
A. 
Any person violating any provision of this article shall be guilty of a violation punishable by a fine not to exceed $5,000 and/or imprisonment for a period not to exceed 15 days. Each day that such violation continues and is not cured shall constitute a separate and distinct violation.
B. 
In addition to the above provided penalties and punishment, the Board of Trustees may also maintain an action in any court of competent jurisdiction to compel compliance with this article by injunction or other action.
