This article is adopted pursuant to Article 26 of the Agriculture and Markets Law of the State of New York and the Village Law of the State of New York for the promotion of the public welfare and health and general welfare of the community, including the protection and preservation of the property of the Village and all its inhabitants, and of peace and good order in establishing requirements for the restriction of the number of and types of animals in the Village of McGraw and to provide for the enforcement thereof.
A. 
Unless otherwise stated herein, all terms shall enjoy their colloquial English usage.
B. 
"Domestic animals" shall include the following:
(1) 
Canine (i.e., dogs).
(2) 
Feline (i.e., cats)
(3) 
Leporine (i.e., rabbits).
(4) 
Galline (i.e., chickens, excluding roosters)
(5) 
Bovine (i.e., cattle).
(6) 
Equine (i.e., horses, donkeys, and mules).
(7) 
Vicugna (i.e., alpaca).
(8) 
Ovine (i.e., sheep).
(9) 
Caprine (i.e., goats).
(10) 
Bees.
A. 
It shall be unlawful for any person to keep, harbor, or otherwise quarter any animal within the corporate limits of the Village other than those listed in § 64-11 herein.
B. 
Residents of the Village may keep, harbor, or otherwise maintain up to three canines and two felines within their residences.
C. 
Residents of the village may keep, harbor, or otherwise maintain a leporine warren of any particular breed which shall not exceed six such animals in total, excluding newly sired rabbits while still suckling.
D. 
Residents of the Village may keep, harbor, or otherwise maintain gallines (i.e., chickens, excluding roosters), provided such animals are maintained on a lot of at least 1/2 acre. In such case, residents of the Village may keep, harbor, or otherwise maintain gallines not to exceed six such animals.
E. 
Residents of the Village may keep, harbor, or otherwise maintain bovines, equines, vicugna, ovines, caprines and bees, provided such animals are maintained on a lot of at least five acres, with a special permit granted at the discretion of the Village Board.
A violation of this article shall be enforceable consistent with the same procedures contained in the provisions of this chapter in §§ 64-7 and 64-8 above.
