With the consent of the Village Manager, personal property of
the Village may be sold by a department head as follows:
A. When the estimated value of an item of personal property is less
than $250, as estimated by the department head, such property may
be sold without securing bids.
B. When the estimated value of an item of personal property is $250
or more, but less than $1,500, as estimated by the department head,
opportunity for competitive bids shall be afforded, but such opportunity
need not be by written bids, and the department shall keep a record
of all bids received.
C. When the estimated value of an item or personal property is $1,500
or more, as estimated by the department head, sealed written bids
shall be requested and received. All sealed bids shall be publicly
opened by the Village Manager. If the bids received exceed $3,500,
the final award shall be made by the Council. The Council may reject
any or all bids. If the Council rejects all bids submitted, it may
direct the Village Manager to negotiate for the sale of such Village
personal property in the open market to the best advantage of the
Village.

Any real estate owned by the Village, except property used or
dedicated for use as a public park, may be sold at a private sale
upon such terms and conditions as the Village Council shall deem appropriate.
Any sale of real estate owned by the Village shall be approved,
if at all, by resolution duly adopted by a concurring vote of 2/3
of the Council members. The vote shall be taken by yeas and nays and
entered in the Council minutes.
The resolution referred to in §
98-3 of this article shall specify which officers of the Village are authorized to execute any documents necessary to effectuate the sale.
This article shall take effect on August 1, 2013, 15 days after
the date of publication.
