As used in this chapter, the following terms shall be defined
as indicated:
PARK OR RECREATION AREA
An area of land owned, leased, supervised or maintained by
the Village for recreational activities or scenic beauty and includes
all public rights-of-way to lakes within the Village.
PARK SUPERVISOR
A person duly authorized by the Village Manager to manage,
supervise or care for a Village park or recreation area.
No person shall commit or assist any person in committing any
act of vandalism in any park or recreation area. Vandalism shall include
the intentional destruction, damage or defacement of any public or
private property, real or personal, without the consent of the owner
having lawful custody of said property and shall include, but not
be limited to, actions taken by cutting, tearing, breaking, marking,
painting or drawing when such actions have the effect of destroying,
damaging or defacing said property.
No person shall place or deposit any garbage, glass, tin can,
paper, refuse or other waste in a park or recreation area, except
in containers provided for that purpose. No person shall deposit garbage,
trash or other refuse generated outside the park or recreation area
as a result of residential or commercial uses in any park or recreation
area refuse container.
No person shall engage in violent or combative activities in
a park or recreation area, except at such times and in such areas
or spaces designated for such exercises or play by the Park Supervisor.
Picnics may be held in such parts of a park or recreation center
as are designated for that purpose by the Park Supervisor.
No swimming, water use or water play or boat launching shall
be engaged in or allowed from any park or recreation area, public
right-of-way or other public place, except at such times and in such
areas or spaces designated for such activities.
No person shall kindle or build a fire in a park or recreation
area, except in a fireplace or stove provided for that purpose. All
such fires shall be attended at all times and shall be extinguished
when no longer in use.
No person shall use any threatening, obscene, profane or indecent
language in a park, recreation area or public place or indulge in
any disorderly or indecent conduct, as may be otherwise defined in
this Code, or in any game, act or demeanor calculated or intended
to interfere with the proper enjoyment of other persons who may be
visiting such park, recreation area or public place.
No person shall post, exhibit or distribute any advertising
material, including but not limited to letters or handbills, within
any public park or recreation area.
No person shall sell, hawk or peddle in a park or recreation
area food, goods, wares or merchandise of any nature, without first
obtaining approval from the Park Supervisor.
A. Driving and parking prohibited. No person shall drive or park a motor
vehicle, moped, motorcycle, off-road recreational vehicle or snowmobile
in a park or recreation area except in spaces set aside and designated
as driving and parking areas. These vehicles are prohibited in those
areas in a park designated as trailways, paths or pedestrian walkways.
Driving and parking on a street or public way in a park or recreation
area shall be subject to the Traffic Code and to such additional rules
and regulations adopted pursuant to this chapter. Driving or parking
on trailways in a park or recreation area shall be subject to the
Village civil infractions code and to such additional rules and regulations
affecting those trailways adopted pursuant to this chapter.
B. Washing and repairing prohibited. Washing, polishing or repairing
of motor vehicles within any park or recreation area is prohibited.
C. Exceptions. The provisions of this subsection shall not apply to:
(1) Vehicles used for repairs and maintenance of a park or recreation
area when performed by the Village or a contractor hired by the Village;
or
(2) Ambulances, police or fire department vehicles, or other emergency
type vehicles required in response to emergencies or other hazardous
or dangerous situations resulting from injuries or sickness to a person
or resulting from fire, storms or other acts creating a hazardous
or dangerous situation to persons or property, or the potential for
one.
A. The Village Manager may adopt such rules and regulations for the
operation of Village parks and recreation areas as shall be necessary
to protect the public morals, health, safety and general welfare,
including but not limited to the preservation of all Village parks
and recreation areas as clean, safe and pleasant places for the enjoyment
of all citizens. Such rules and regulations shall become effective
upon the approval of the Village Council and shall be posted in a
conspicuous place or places within each park or recreation areas.
However, the failure to place any rule or regulation in any Village
park and recreation areas shall not affect its enforceability.
B. Any person who shall violate any rule or regulation adopted and approved in accordance with this section shall be deemed guilty of a misdemeanor, punishable as described in §
1-6 of this Code. In addition, the Village Manager may revoke any license, permit or other privilege granted under the provisions of such rules or regulations whenever the person to whom the same was granted is convicted of violating such rules and regulations. In such case, all fees paid by such person for such privilege shall be forfeited.
No person shall possess any alcoholic liquor, as that term is
defined in the Michigan Liquor Control Act, in a container which is
open, uncapped or upon which the seal is broken or consume any said
alcoholic liquor in any park or recreation area; provided, however,
that alcoholic liquor may be sold, possessed and consumed in such
park or recreation area as may be in accordance with a special license
granted by the Village Council and in conformance with the condition
of such approval and condition of a special license granted by the
Michigan Liquor Control Commission.
Each park and recreation area is designated as a "bird preserve."
No person shall trap, hunt, shoot, disturb, or attempt to do so, any
bird or their nests within a park or recreation area.
No person shall enter upon or remain in a park or recreation
area at times other than during the posted times when said park or
recreation area is open to the public.
No person shall carry or discharge firearms of any description,
slingshots, shoot arrows, discharge fireworks, firecrackers, rockets
or any other type of fireworks, or items containing any substance
of any explosive nature within any park or recreation area, except
those firearms carried by an authorized police officer in the course
of his or her duty.
No person shall ride, lead or cause a horse or other livestock
to be upon any park or recreation property unless organized activities
are permitted with the approval of the Village Council.
No person shall make any ascent in any balloon, helicopter or
airplane or any nonemergency descent in or from any balloon, helicopter
or airplane or shall parachute onto any park or recreation area without
prior written consent of the Village Council.
No person shall dig or remove soil, rocks, stones, trees, shrubs
or plants from any park or recreation area. No person shall attach
any wire, rope or other device to any tree, plant, public utility
pole or any other structure within any park or recreation area.
No person, organization, club or group shall hold or participate
in any parade, drill, exhibition, political meeting, religious meeting,
concerts, lectures, or public entertainment within any park or recreation
area without the prior consent of the Village Council.
No person shall loiter in, about, or upon any drive, walk, lane,
parking lot or other place in any Village park or recreation area.
For purposes of this section, "loitering" shall mean any act of standing
or idling about, whether done by an individual or group of individuals,
which hinders or impedes the passage of vehicles or pedestrians.
No person shall permit the entry of a dog or other domestic
animal into parks and recreation areas other than automobile parking
areas and walks immediately adjacent thereto and in such other areas
as may be clearly marked by signs bearing the words: "Domestic animals
permitted in this area." All dogs in those areas where such animals
are permitted shall be restrained at all times on adequate leashes
not greater than six feet in length. All persons in control of a dog
will be responsible for cleaning up feces deposited in any park or
recreation area.
Each park and recreation center is designated as an "animal
preserve." No person shall hunt, trap, molest, harm, frighten, kill,
trample, chase, tease, shoot, or throw any objects at any animal.
No person shall remove or have in their possession the young of any
wild animal or the eggs, nest or young of any animal. No person shall
give, offer, or attempt to give any animal any tobacco, alcohol, or
other known noxious substances.
No person shall throw, discharge, or otherwise place or caused
to be placed in the waters of any fountain, pond, lake, stream, tributary,
storm sewer or other body of water in or adjacent to any park or recreation
area any matter or thing, liquid or solid, which will or may result
in the environmental contamination of such waters.
No person shall play any radio, tape, compact disc player or
other electronic or mechanical sound-producing device, including any
musical instrument, with such volume as to unreasonably upset or disturb
the quiet, comfort or repose of other persons in any park or recreation
area or areas immediately adjacent thereto.
No person shall engage in any disorderly conduct in any park or recreation area as that term is defined in §
200-2 of this Code.
No persons shall interfere with any Village, park or recreation
area employee exercising his or her duty within any park or recreation
area or shall fail or refuse to obey any lawful command or administrative
regulation which is in effect for that park or recreation area as
directed by any such employee, nor shall any person in any way interfere,
hinder or prevent such employee from discharging his or her duty or
in any manner assist or give aid to any person in custody to escape
or to attempt to escape or to attempt to escape from custody. No person
shall interfere with or in any manner hinder any employee of the Village
while engaged in constructing, repairing or caring for any Village
park or recreation property.
Unless otherwise stated, any violation of this chapter shall be a misdemeanor punishable as provided in §
1-6 of this Code.
