It is the purpose of this article to protect the public health, safety and general welfare of persons and property within the Village through the regulation and control of motor carrier operations within the Village.
Any police officer having reason to believe that the load, weight or height of a vehicle is in violation of § 445-18 may require the driver of the vehicle to stop, and the officer may investigate, weigh or measure the vehicle or load. If after personally investigating, weighing or measuring the vehicle or load, and if the officer determines that the vehicle or load is in violation of the provisions of § 445-18, the officer may temporarily detain the driver of the vehicle for purposes of making a record or vehicle check and may arrest the driver for any misdemeanor violation of §§ 445-18 through 445-20, and for any other infraction the officer may proceed as otherwise provided in §§ 445-18 through 445-20.
Every person convicted or found responsible for a violation or found to be in violation of §§ 445-18 through 445-20 or any rule or regulation adopted or issued pursuant to the provisions of §§ 445-18 through 445-20 shall be subject to the fine and/or other penalties as provided under §§ 445-18 through 445-20. However, the maximum possible penalty for a violation of this article shall be 90 days in jail and/or $500 in fines.
Sections 223, 225, 256, 328, 643a, and Sections 717 through 726b set forth in Act No. 300 of the Public Acts of Michigan of 1949 (MCLA §§ 257.223, 257.225, 257.256, 257.328, 257.643a, and MCLA §§ 257.717, 257.726b), as amended, are hereby adopted by reference. A copy of this act shall be available at the office of the Village Manager for inspection by the public.
The Motor Carrier Safety Act of 1963, Act No. 181 of the Public Acts of Michigan of 1963 (MCLA § 480.11 et seq.), as amended, together with rules and/or regulations promulgated pursuant to the Act by the Department of State Police, Motor Carrier Division, are hereby adopted by reference. A copy of this Act shall be available at the office of the Village Manager for inspection by the public.
No person shall act as a motor carrier within the Village unless such person is the holder of an unrevoked license and decal license issued pursuant to the Motor Carrier Fuel Tax Act, Act No. 119 of the Public Acts of Michigan of 1980 (MCLA § 207.211 et seq.), as amended. A copy of this Act shall be available at the office of the Village Manager for inspection by the public.
