The Town Board of the Town of Arbor Vitae, Vilas County, hereby
adopts this article pursuant to the provisions of § 101.65
of the Wisconsin Statutes.
This article shall be known as the "State Uniform Dwelling Code"
of the Town of Arbor Vitae and shall be referred to as such.
This code shall apply to all new one- and two-family dwellings
and to all additions and alterations to all buildings regardless of
age. Plans and inspections will cover topics of construction, heating,
ventilating, electrical, and plumbing.
Wisconsin Administrative Code Chapters SPS 320 through 325.
Whose effective date is June 1, 1980 (except Chapter SPS 322, which
was adopted December 1, 1978), and all amendments thereto are hereby
adopted and reference made a part of this article. Any future amendments
and revisions to the UDC are intended to be made a part of this article
in the interest of statewide uniformity. A copy of the UDC shall be
kept on file in the office of the Building Inspector.
No construction of any one- or two-family dwellings shall take
place unless a building permit for that work shall first be obtained
by the owner or his authorized agent from the Building Inspector.
(Also a zoning permit must be evident from the Vilas County Zoning
Office.)
A. Application forms to be used. The Building Inspector shall use forms
prescribed by DSPS and file a copy of each form with DSPS per § 101.65(3),
Wis Stats.
B. Submission of plans. The applicant shall submit two copies of plans
at the time the building permit is filed.
C. Issuance of permit. If the Building Inspector determines that the
building plans in every respect comply with the UDC, a permit shall
be issued. After being approved, the plans and specifications shall
not be altered except with the approval of the Building Inspector.
The issued building permit shall be posted in a conspicuous place
at the building site.
D. Permit lapse. The building permit will expire in two years. The exterior
of the building shall be completed within the time frame of the first
permit. An additional permit will be required if the building is not
completed within the time frame of the first permit. Any additions
or construction will require a new permit.

Effective April 1, 2007, the Town of Arbor Vitae, WI, Vilas
County, is in compliance with the Department of Safety and Professional
Services Chapter 320, Administration and Enforcement, as it pertains
to the permitting and inspection of manufactured homes in manufactured
home communities. Such permitting and inspection will be conducted
by the Town of Arbor Vitae Building Inspector in accordance with all
the provisions of §§ SPS 320.01, 320.02, 320.03, 320.04,
320.05, 320.06, and 321.40, along with § 101.96, Wis. Stats.,
as it pertains to installation of manufactured homes (installation
standards). Fees will be set by the Building Inspector per approval
of the Town Board, with the number of inspections to be at the discretion
of the Building Inspector.
There is hereby created the position of Building Inspector who
shall administer and enforce this article and the UDC code.
A. Appointment. The Building Inspector shall be appointed by the Town
Board.
B. Qualifications. The Building Inspector shall have the necessary qualifications
as stated in Ch. SPS 305, Subchapter VI, Inspectors, and be certified
by the state in the categories for which he/she is appointed.
C. General powers and duties. The Building Inspector shall administer
and enforce all provisions of this article and the UDC. The Building
Inspector may at all reasonable times enter upon any public or private
premises for inspection purposes. No person shall interfere with the
inspector while in the performance of the duties as described herein.
D. Records. The Building Inspector shall keep a record of all permit
applications issued. The permits shall be marked in order and shall
coordinate with the seal numbers purchased from the state. The records
shall also detail number, description, size, cost, materials used,
and aggregate cost of all UDC construction. The Building Inspector
shall make an annual report to the appointing authority.
When the Building Inspector cites violations with this code
or the UDC, the violations shall be promptly corrected. All written
violations shall be corrected within 30 days unless an extension of
time is granted pursuant to § DSPS 20.21 of the UDC.
A. Stop order. If written violations are not corrected after 30 days,
the Building Inspector shall issue a stop order to the owner. The
stop order shall be posted at the construction site.
B. Penalties. Any person in violation with this article or the UDC shall,
upon conviction, be subject to a forfeiture of not less than $25 or
more than $500 together with the cost of prosecution. Each day that
such violation continues will constitute a separate offense (§§ 66.0113,
66.0114 and 101.66, Wis. Stats.).
C. Fines or penalties:
(1) Work started without a UDC permit: $200.
(2) Work done without inspection (first offense): $100.
(3) Work done without inspection (second offense): $200.
(4) Code violations (30 days to correct): No fine.
(5) Code violations, if not corrected within 30 days: $100.
(6) Each additional day will constitute an additional fine: $10.
Any person feeling aggrieved by an order of the Building Inspector
may within 20 days thereafter appeal from such order to this appointing
authority. The procedures set forth in Chapter 68, Wis. Stats., shall
be followed by the Town in arriving at a final determination of the
appeal. Such final determination may be reviewed as set forth in Wisconsin
Administrative Rules § DSPS 20.21.
