That there be and is hereby established a Swimming Pool Board,
which Board shall consist of five (5) persons who qualify for appointment
by State statute.

The Mayor of the City of Sweet Springs, Missouri, shall appoint
such members of the Swimming Pool Board, and appointments shall be
confirmed by the Board of Aldermen in such manner as other appointive
officers are appointed and confirmed.

That the members of said Board shall hold office for a term
of five (5) years each, except the first incumbents, who shall be
appointed and hold office for the term of one (1), two (2), three
(3), four (4) and five (5) years, respectively.

In case a vacancy shall exist in said Board, such vacancy shall
be filled in the same manner as original appointments are made to
said Board, but the vacancy shall be filled only for the unexpired
term of the vacation member.

That the members of the Swimming Pool Board shall serve without
salary or remuneration except for the Secretary thereof.

Any members of said Board who shall accept a nomination of appointment
for any other City office during his/her official term, shall be deemed
thereby to have resigned as a member of said Board, and his/her membership
shall thereby be ipso facto vacated.

The Swimming Pool Board shall meet at least once a month in
its office. Three (3) members of said Board shall constitute a quorum.

Said Swimming Pool Board shall have the power, and it shall
be its duty, to take charge and exercise control over the municipal
swimming pool of the City and real estate thereof, which may be owned
by such City by purchase or otherwise, and of all appurtenances thereto
belonging, and shall enforce the performance of all contracts and
work, and have charge and custody of all books, property and assets
belonging to or appertaining to such swimming pool.

Said Board shall also exercise such other powers and perform
such other duties and superintend all improvements and repairs constructed
by authority of the Board of Aldermen or owned by the City as may
be prescribed by ordinance. Said Board shall make all necessary regulations
for the operation and maintenance of the swimming pool, not inconsistent
with the general laws of the State, the charter of this City, or the
ordinances thereof.

There shall be a President, Secretary and Vice President of
the Swimming Pool Board, who shall be elected by majority vote by
said Board and at its pleasure removed.

All bills of such Board and all salaries of its employees shall
be allowed and paid in the same manner that bills and salaries of
other officers and employees of such City are allowed and paid.

It shall be the duty of the Swimming Pool Board to keep books
of account, showing with entire accuracy, current entries of the receipts
and expenditures of the Board in such manner as to enable the same
to be understood and investigated, and also to preserve on file in
its office duplicate vouchers for all its expenditures, which books
and duplicates shall at all times be open to the examination of the
Board of Aldermen, or any other committee appointed by the Board of
Aldermen, and such Board shall, through its Secretary, make monthly
and annual reports of its business and transactions to the Mayor and
the Board of Aldermen of said City and shall cause its annual report
to be published in a newspaper published in the City of Sweet Springs,
Missouri.

The doing of all work furnishing of all supplies for the swimming
pool may be under its supervision or control, shall be let out by
the Swimming Pool Board in the same manner as other public works are
let out, except in cases where it is not practicable to do such work
or furnish such material by contract, and all contracts shall be submitted
to the Board of Aldermen for approval. Said Board may have charge
of the purchase of all supplies needed in its operations, under such
restrictions and regulations as may be provided by ordinance.

All contracts as provided in the preceding section, and official
acts of the Swimming Pool Board, shall be signed by the President
or by two (2) members of said Board and attested under the hand of
the Secretary.

The assessment and collection of rates for use of the swimming
pool, or for the product or service of any other function of the swimming
pool, will be set by the Swimming Pool Board, subject to the ordinances
of this City.

The Swimming Pool Board of the City of Sweet Springs shall have
the power and, in its discretion, may issue limited permits for swimming
pool usage after regular hours. The Swimming Pool Board is authorized
to set fees for such limited permits and to regulate such after-hour
usage. No such limited permit shall be issued which in any way would
conflict with the regular-hour usage of said pool, and the Swimming
Pool Board shall have full discretion in the issuance of any such
limited permits.
