The Village of Browntown, Green County, Wisconsin, adopts the following ATV/UTV route ordinance for the operation of all-terrain and utility vehicles upon the roadways listed in §
264-3. This route has been created after due consideration of the recreational value of connecting to trail opportunities and weighted against possible dangers, public health, liability aspects, terrain involved, traffic density and history of automobile traffic.
This chapter is created pursuant to Village authority as authorized
by § 23.33(8)(b), Wisconsin Statutes, and the provisions
of § 23.33, Wis. Stats., are herein adopted. The applicable
provisions of § 23.33, Wis. Stats., regulating ATV/UTV operation
pursuant to routes are adopted.
The Village of Browntown has designated a system of ATV/UTV
routes on all of its Village roads. Operation on county roads and
state highways is not permissible except for County M (Mill Street)
within the limits of the Village of Browntown.
As a condition for the use of these routes, the following provisions
shall apply to all operators and passengers of ATV/UTVs:
A. All ATV/UTV operators shall ride single file.
B. All ATV/UTV operators shall not exceed 30 mph on roads.
C. All ATV/UTV operators shall slow the vehicle to 10 mph or less when
operating within 150 feet of a dwelling.
D. The roads indication shall be closed daily to all ATV/UTV operators
from 1:00 a.m. to 5:00 a.m.
E. Routes must be signed in accordance with §§ NR 64.12
and NR 64.12(7)(c), Wis. Adm. Code.
This chapter shall be enforced by any law enforcement officer
as authorized to enforce the laws of the State of Wisconsin. The Village
of Browntown may modify, suspend, or revoke the privileges of its
route system with proper notice.
State of Wisconsin all-terrain vehicle and utility vehicle penalties
as found in § 23.33(13)(a), Wisconsin Statutes, are adopted
by reference.

The provisions of this chapter shall be deemed severable, and
it is expressly declared that the Village of Browntown would have
passed other provisions of this chapter irrespective of whether or
not one or more provisions may be declared invalid. If any provision
of this chapter or the application to any person or circumstances
is held invalid, the remainder of the chapter and the application
to any person or circumstance shall not be affected.

of Trustees of the Village of Browntown by a vote of four ayes and
zero nays.
