156-13, for fees for recreation.
Permits for special events in parks shall be obtained by application
to the Department of Recreation in accordance with the following procedure:
A. A person seeking a permit hereunder shall file an application with
the Department of Recreation stating:
(1) The name and address of the applicant.
(2) The name and address of the person sponsoring the activity.
(3) The day and hours for which the permit is desired.
(4) The park or portion thereof for which such permit is desired.
(5) An estimate of the anticipated attendance.
(6) Any other information which the Department shall find reasonably
necessary to a fair determination as to whether a permit should be
issued hereunder.
B. Standards for issuance of a use permit by the Department shall include
the following findings:
(1) That the proposed activity or use of the park will not unreasonably
interfere with or detract from the general public enjoyment of the
park.
(2) That the proposed activity and use will not unreasonably interfere
with or detract from the promotion of public health, welfare, safety
and recreation.
(3) That the proposed activity or uses that are reasonably anticipated
will not include violence, crime or disorderly conduct.
(4) That the proposed activity will not entail extraordinary or burdensome
expense or Police operation by the Township.
(5) That the facilities desired have not been reserved for other use
at the date and hour requested in the application.
C. Within five days after the receipt of an application, the Department of Recreation shall apprise an applicant, in writing, of its reasons if it refuses a permit, and any aggrieved person shall have the right to appeal to the Township Council by serving written notice thereof on the Township Clerk within five days of such refusal. A copy of such notice shall also be served on the Department within the same time, and such Department shall immediately forward the application and the reasons for its refusal to the Township Council, which shall consider the application under the standards set forth under Subsection
B of this section and sustain or overrule the Department's decision within 10 days from the receipt of the appeal by the Township Clerk. The decision of the Township Council shall be final.
D. A permittee shall be bound by all park rules and regulations and
all applicable ordinances.
E. The person to whom the permit is issued shall be liable for all loss,
damage or injury sustained by any person whatsoever by reason of the
negligence of the person to whom such permit shall have been issued.
The Department of Recreation shall have the right to require any permittee
to submit evidence of liability insurance covering injuries to members
of the general public arising out of such permitted activities in
such amounts as may be from time to time determined by the Department
prior to the commencement of any activity of issuance of any permit.
F. The Department of Recreation shall have the authority to revoke a
permit upon a finding of violation of any rule or ordinance, or upon
good cause shown.

A. No owner or driver shall cause or permit his vehicle to remain outside
of designated parking spaces, except for a reasonable time to take
up or discharge passengers or equipment. No motor vehicle shall be
parked in such park areas from 1/2 hour after sunset until sunrise,
except as otherwise permitted.
B. No motor vehicles, including automobiles, motorcycles, all terrain
vehicles (ATVs), trucks, vans and campers, except Township vehicles
or Township authorized vehicles conducting park maintenance activities
or emergency service functions, shall be permitted to operate or be
parked on Township parkland, playgrounds, or trolley right-of-way,
except in designated driveways and parking lots.

The Department of Recreation and park attendants shall:
A. Diligently enforce the provisions of this chapter.
B. Have the authority to eject from the park area any person or persons
acting in violation of this chapter.
C. Have the authority to seize and confiscate any property, thing, or
device in the park used in violation of this chapter.
D. Any motor driven vehicle or device seized pursuant to Subsection
C of this subsection will be towed at owner's expense and shall be only returned upon payment of the fees and fine or by order of the court.
This chapter shall be enforced by the Police Department.
The Township reserves the right with respect to any or all of
the public park and recreation areas, and any facilities located therein,
to enter into any agreement with the Board of Education of the Township
concerning the control and use thereof, and, anything contained in
this chapter to the contrary notwithstanding, any use of such premises
or such facilities by the Board of Education pursuant to any agreement
with the Township Council or Department of Recreation heretofore or
hereafter entered into shall be free and exclusive from any control
or supervision of or by the Department.

A violation of any provision of this chapter will subject the violator to the fines and penalties prescribed for ordinance violations under Chapter
1, Article
III, General Penalty, of the Township Code.
