For the purpose of this article only, the following words and phrases shall have the meanings respectively ascribed to them in this section, except when the context requires other meanings:
PERSON
Any natural person, firm, partnership, association, corporation, company or organization of any kind.
TOWNSHIP
Township of Silver Spring.
No person owning or occupying any property within the Township shall permit limbs, branches or growth of trees, shrubbery, bushes or other plant growth to be at least 20 feet in height or clearance over the cartway of any highway, road, street or alley; or at least eight feet in height or clearance over any sidewalk or footway; or to otherwise obstruct, impede traffic or the public. This would include any dead or hazardous trees the Township would conclude to be a safety concern to the public.
The owner of any vacant property or the owner or occupant of any occupied property shall trim, cut or remove all trees, shrubbery, bushes, other plant growth growing on the property violating any provisions of this article, to include any trees or vegetation obstructing the sight distance at any intersection of any road or alley.
The Township Manager or any officer or designee is hereby authorized to give notice, by personal service or by mail, to the owner or occupant, as the case may be, of any property whereon there is a violation of the provisions of this article, directing and requesting such owner or occupant to trim, cut or remove such tress, shrubbery, bushes or other plant growth so as to conform to the requirements of § 377-2 within 30 days after issuance of such notice.
In case any person shall neglect, fail or refuse to comply with such notice within the given period of time, the Township authorities may trim, cut or remove such trees, shrubbery, bushes or any other plant growth, or may enter into a contract to cause the same to be done, and the costs together with a penalty of 10% of these costs may be collected by the Township from such person in the manner provided by law.
Any person, firm or corporation who shall violate any provision of this article shall, upon conviction, be sentenced to pay a fine of not more than $500. In default of payment of said fine, each day an additional $10 is to be added.
