(a)Â
Where the approval of any Borough officer or State officer is required
prior to the issuance of any license or permit, such approval must
be presented to the Licensing Official before any license or permit
is issued.
(b)Â
No license or permit shall be approved by any Borough officer or
issued by the Licensing Official (1) if it appears that the conduct
of the activity for which a license or welfare of the public, or any
regulation, law or ordinance applicable to such activity, and (2)
unless the applicant, if he is the owner thereof, pays any delinquent
property taxes or assessments on the property wherein the business
or activity for which the license or permit is sought or wherein the
business or activity is to be conducted.
(a)Â
Any license or permit issued by the Borough may be suspended or revoked
by the Administrator or Council for any of the following causes:
1.Â
Fraud, misrepresentation or incorrect statement contained in the
application or made in carrying on the licensed or permitted activity;
2.Â
Conviction of any crime or misdemeanor where the conviction relates
adversely to the activity authorized by the Borough;
3.Â
Conducting such activity in such manner as to constitute a breach
of the peace, or a menace to the health, safety or welfare of the
public, or a disturbance of the peace or comfort of residents of the
Borough; upon recommendation of the appropriate official;
4.Â
Expiration or cancellation of any required bond or insurance;
5.Â
Actions unauthorized or beyond the scope of the license or permit
granted;
6.Â
Violation of any regulation or provision of these Revised Ordinances
applicable to the activity for which the license or permit has been
granted, or any regulation or law of the state so applicable;
7.Â
Failure to continuously comply with all conditions required as precedent
to the approval of the license or permit; or
8.Â
Failure of the licensee or permittee, if he is the owner of the property
upon which the licensed business or activity is conducted, to pay
the taxes due on the property for at least three consecutive quarters,
provided that upon payment of the delinquent taxes or assessment,
the license or permit shall be restored.
(b)Â
The suspension or revocation of any license or permit shall not preclude
the imposition of a penalty for violation of any ordinance of the
Borough.
All ordinances of the Borough of Waldwick which are inconsistent
with the provisions of this ordinance are hereby repealed to the extent
of such inconsistency.
If any section, subsection, sentence, clause or phrase of this
ordinance is for any reason held to be unconstitutional or invalid,
such decision shall not affect the remaining portions of this ordinance.
This ordinance shall take effect immediately upon final passage,
approval and publication as required by law.
