Whenever any words and phrases are used in this chapter, the
meaning respectively ascribed to them in Subtitle 1 of Title 39 of
the Revised Statutes of New Jersey shall be deemed to apply to such
words and phrases used herein.

Whenever certain hours are named in this chapter, they shall
mean either Eastern Standard Time or Eastern Daylight Savings Time
as may be in current use.

a. The
Chief of Police or, in his/her absence, disability or inability to
act, the ranking member of the Police Department, is hereby authorized
to provide by regulation for the closing of any street or portion
thereof to motor vehicle traffic on any day or days during specified
hours on any day or days whenever he/she finds that such closing is
necessary for the preservation of the public safety, health or welfare.
b. Any
regulations promulgated by the Chief of Police and in accordance with
paragraph a above, shall provide for the posting of proper warning
signs of such closing on any street or portion thereof during the
time the same is closed in pursuance thereof.
c. Any
violation of this regulation promulgated thereunder shall be punished
by a fine not to exceed $50.
d. Any
regulation adopted that mandates the closing of any street for a period
greater than 48 consecutive hours shall not become effective unless
and until it has been submitted to and approved by the Commissioner
of the Department of Transportation.

Any vehicle parked in violation of this chapter shall be deemed
a nuisance and a menace to the safe and proper regulation of traffic,
and any Police Officer may provide for the removal of that vehicle.
The owner shall bear the reasonable costs of removal and storage which
may result from such removal before regaining possession of the vehicle.

Unless another penalty is expressly provided by New Jersey Statute,
every person convicted of a violation of a provision of this chapter
or any supplement thereto shall be liable to a penalty of not more
than $75 or imprisonment for a term not exceeding 15 days or both.

If any part or parts of this chapter are, for any reason, held
to be invalid, such decision shall not affect the validity of the
remaining portions of this chapter.
a. When Effective. This Chapter
7 shall take effect upon final passage and publication according to law and its approval by the Commissioner of Transportation as provided by law.

All former traffic ordinances of the Borough of Watchung are
hereby repealed, and all ordinances or parts of ordinances in conflict
with or inconsistent with the provisions of this chapter are hereby
repealed, except that this repeal shall not affect or prevent the
prosecution or punishment of any person for any act done or committed
in violation of any ordinance hereby repealed prior to the taking
effect of this chapter.

The Governing Body finds and declares that problems of traffic
control occur when traffic must be moved through or around street
construction, maintenance operations and utility work, above or below
ground, which requires blocking the roadway and obstructing the normal
flow of traffic; and that such obstructions are or can become dangerous
when not properly controlled. In order to better promote the public
health, safety, peace and welfare, it is necessary to establish controls
and regulations directed to the safe and expeditious movement of traffic
through and around construction and maintenance zones and to provide
safety for the work forces performing these operations.
The Borough of Watchung, in the County of Somerset, State of
New Jersey, does hereby adopt the current Manual on Uniform Control
Devices for Streets and Highways hereafter known as the M.U.T.C.D.,
except as hereby supplemented and amended, as it controls and regulates
whenever construction, maintenance operations or utility work obstructs
the normal flow of traffic. Any person, contractor or utility who
fails to comply with the provisions of the M.U.T.C.D. while performing
such work is in violation of this section.

It shall be the responsibility of the person, contractor, or
in the case of a public utility as required under the public utility
agreement, wishing to conduct work on, under or above the roadway
to contact the Police Department in order to arrange a preconstruction
meeting in order to submit plans for the safe movement of traffic
during such period of construction or work. Any person, contractor
or utility who fails to comply with this section prior to the start
of such work, or whose plans are not approved by the Police Department
of the Borough of Watchung is in violation of this section.

The person, contractor, or utility shall provide the Police
Department with at least two emergency contact telephone numbers to
be called in case of emergency problems at the construction or maintenance
site prior to the start of any work. If, for any reason, emergency
contact cannot be made, or if the emergency contact person does not
respond to a call from the Police Department to correct such hazardous
condition, the Borough may respond to correct the hazardous condition(s).
The reasonable fees for such emergency services by the Borough shall
be charged to the person, contractor, or utility responsible for the
condition.

There shall be no construction, maintenance operations, or utility
work on any roadway in the Borough before the hour of 9:00 a.m. or
after 4:00 p.m. This time limit may be adjusted to permit work prior
to 9:00 a.m. or after 4:00 p.m. by the officer in charge of the Police
Department. If it is determined by the officer in charge that the
construction or maintenance operations prior to 9:00 a.m. or after
4:00 p.m. would substantially delay traffic or cause a safety or health
hazard, the work shall then be permitted only between 9:00 a.m. and
4:00 p.m.

Road closings and/or traffic detours shall not be permitted
unless approved by the Borough Police Department.

Traffic directors shall be posted at all construction or maintenance
sites when determined by the Borough Police Department that same is
necessary to provide for the safety and expeditious movement of traffic.

The Police Department shall have the authority to stop work,
including the removal of equipment and vehicles, stored material within
the street right-of-way, back filling of open excavations and/or other
related work, in order to abate any nuisance and/or safety hazard
or for any violation of this section.

It is to be expressly understood that no materials, vehicle
or equipment are to be placed in the roadway or sidewalk or until
all construction, signs, lights, devices and pavement markings are
installed.

Any person, contractor or utility who commits a violation of
this section shall, upon conviction thereof for a first offense, pay
a fine of not less than $100 nor more than $500 and/or be imprisoned
in the County jail for a term not exceeding 90 days. For a second
offense, the person, contractor or utility shall, upon conviction
thereof, pay a fine of not less than $250 and/or be imprisoned in
the County jail for a term not exceeding 90 days.
A separate offense shall be deemed committed on each day during
or on which a violation occurs or continues.

All ordinances or parts of ordinances which are inconsistent
with the provisions of this section are hereby repealed to the extent
of any such inconsistency.

This chapter shall take effect after approval by the Commissioner
of Transportation 20 days after passage and publication as prescribed
by law.

The provisions of this chapter imposing a time limit on parking
shall not relieve any person of the duty to observe other more restrictive
provisions prohibiting or limiting the stopping or standing or parking
of vehicles as set forth in N.J.S.A. 39:4-138, any other New Jersey
Statute or as hereinafter provided.

a. Upon the declaration of an emergency, there shall be no parking upon
the streets where temporary EMERGENCY NO PARKING signs are displayed.
The Chief of Police or, in his/her absence, the ranking Police Officer
is authorized to declare an emergency and to direct the posting of
EMERGENCY NO PARKING signs when weather conditions, accidents, road
construction, fire or public celebrations dictate or require avoidance
of hazards or other conditions which interfere with the free flow
of traffic. Notification that EMERGENCY NO PARKING signs are being
or will be posted shall be given to the operator or owner of any vehicle
which has been parked prior to the posting of the signs.
b. The effectiveness of this subsection is contingent upon the signs
being erected as required by law.
c. Any unoccupied vehicle parked or standing in violation of this subsection
shall be deemed a nuisance and a menace to the safe and proper regulation
of traffic and any Police Officer may provide for the removal of such
vehicle. The owner shall pay the reasonable costs of the removal and
storage which may result from such removal, before regaining possession
of the vehicle.

a. Whenever snow has fallen and the accumulation is such that it covers
the streets and highways, an emergency shall exist and no vehicles
shall be parked on any of the streets or highways within the Borough.
This parking prohibition shall remain in effect after the snow
has ceased until the streets have been plowed significantly, and to
the extent that parking will not interfere with the normal flow of
traffic.
b. Any unoccupied vehicle parked or standing in violation of this section
shall be deemed a nuisance and a menace to the safe and proper regulation
of traffic and any Police Officer may provide for the removal of such
vehicle. The owner shall pay the reasonable costs of the removal and
storage which may result from such removal before regaining possession
of the vehicle.

In accordance with the provisions of N.J.S.A. 40:48-2.46, the
following private property that is open to the public and to which
the public is invited, the movement of traffic shall be controlled
by the types of regulations indicated. No person shall operate or
park a vehicle in violation of the following regulations.
a. Blue Star Shopping Center. D.O.T. Approved 7.29.70
1. Pursuant to the provisions of N.J.S.A. 40:48-2.46, no person shall
park or leave standing a vehicle at any time upon that portion of
land in the Blue Star Shopping Center known as Lot 11, Block 64, Route
22, Watchung, New Jersey, and being more specifically described as
follows: Beginning at the westerly corner, adjacent to the existing
curb of the Blue Star Shopping Center Stores, said corner as of this
date being occupied by Dress Barn; thence from said point in a northeasterly
direction a distance of approximately 600 feet to an angle point;
thence continuing in a northeasterly direction along the curb of said
stores a distance of approximately 1,200 feet to another angle point,
said point being in the westerly line of a building this date designated
as C.J. Becker School Supplies; thence continuing in a northeasterly
direction a distance of approximately 350 feet to another angle point,
said point being at the easterly edge of a building this date designated
as Funcoland; thence continuing again in a northerly direction a distance
of approximately 150 feet to the end of a building this date designated
as Blue Star Cleaners. The no parking zone shall be 32 feet in width
for a distance of 2,300 feet.
Additionally, no person shall park or leave standing a vehicle
at any time upon that portion of land specifically described as follows:
Beginning at the northeasterly corner of the existing curb of a building
this date designated as T.G.I. Fridays and continuing in a westerly
direction a distance of approximately 180 feet to an angle point;
thence continuing in a southerly direction along the curb of said
building a distance of approximately 100 feet to an angle point; thence
continuing in an easterly direction along the curb of said building
a distance of approximately 140 feet to the curb's terminus. The no
parking zone shall be 40 feet in width for a distance of 420 feet.
2. All of the land area described in paragraph a, 1 is hereby designated
a no parking zone.
3. Signs and necessary markings shall be erected designating the above
land area as no parking zones and placed and maintained as required
by the Commissioner of Transportation.
b. The owners of the premises referred to in this section shall provide
and install signs and pavement markings as required, which signage
and markings shall be in accordance with the current Manual On Uniform
Traffic Control Devices (MUTCD). The cost of signs and installations
shall be the responsibility of the owner of said property. The owner
shall, subsequent to the initial procurement and installation, maintain
such signs and pavement markings in good condition at no cost or expense
to the Borough of Watchung.
c. The penalty for a violation and conviction of this section shall
be not less than $50 nor more than $1,000 and/or imprisonment in the
County jail for a term not to exceed 90 days, or by a period of community
service not to exceed 90 days.

In accordance with the provisions of N.J.S.A. 39:5A-1 the regulations
of Subtitle 1, Title 39 of the Revised Statutes are hereby made applicable
to the properties listed below.

Regulatory and warning signs shall be erected and maintained
to effect the above designated speed limits authorized by the Department
of Transportation.
4. Tow-Away Zones: Any vehicle parked or standing as to obstruct or
impede a normal flow of traffic block entrances or exit ways, loading
zones, oil fills, any grassy area pedestrian walkway, or present in
any way a safety or traffic hazard may be removed by towing the vehicle
at the owner's or operator's expense. That all signs, posts, or other
necessary materials be installed and paid for by the applicant. All
signing shall conform to the current Manual on Uniform Traffic Control
Devices, pursuant to N.J.S.A. 39:4-198 and N.J.S.A. 39:4-183.27.
Unless another penalty is expressly provided for by the New
Jersey Statute, every person convicted of a violation of this paragraph
a or any supplement thereto shall be liable to a penalty of not more
than the maximum penalty allowed or imprisonment for a term not exceeding
15 days or both.

Lake Park municipal parking lot.
3. The Police Department and Department of Public Works are hereby authorized
to post signs at the Watchung Lake Park municipal parking lot briefing
the public on this section and consistent with the rules and regulations
applicable to signs.
4. For violations of this subsection
7-40.4, the offender shall be liable for a penalty of $50.
