Junkyards are described as follows for the purposes of this
chapter and the regulatory provisions provided for herein: any lot
or parcel of land in the Township of Montague upon which is situate
two or more unregistered motor vehicles or parts of vehicles the sum
of which equals or exceeds in bulk two motor vehicles or upon which
is situate boilers, automobiles or parts of same, plumbing fixtures,
building materials or any other wastes or junk materials which equal
or exceed in bulk two motor vehicles is deemed to be a junkyard. Farm
tractors in working condition, although unregistered, shall not be
considered in determining whether a junkyard exists.
No person, firm or corporation shall maintain or suffer or permit
the maintenance of a junkyard in said township without first obtaining
a license therefor.

A. An applicant for a license to operate a junkyard in said township
shall file written application with the Township Clerk for the attention
of the Township Committee and shall state his name and post office
address and describe the lot or parcel to be licensed as a junkyard.
B. Said application shall be accompanied by cash or certified check,
payable to "Treasurer, Township, Montague" for the license fee hereby
fixed at $250 per year. [8-9-88 by Ord. No. 88-15]
C. The license period shall be January 1 to December 31 and the fee
may be prorated from the date of issuance within said period to the
following December 31.
D. The license shall be renewed annually by payment of the fee by the
licensee on or before January 2 of the license year.
E. A license shall be subject to revocation or suspension upon proof
of any violation hereunder after a hearing conducted by the Township
Committee.
A licensee hereunder shall maintain the premises so that no
junk shall be deposited within 40 feet of any public road or way and
shall erect and maintain a neat solid wall or fence of a height not
less than seven feet above the ground level, set back at least 40
feet from the public road and of sufficient length to effectively
screen junk from the view of users of the highways.
Where topography of the yard in relation to the public road
is such that fencing is unnecessary, the Township Committee may, on
special application, waive this requirement.

Each and every person, firm or corporation violating any part
or provision of this chapter shall, upon conviction thereof before
a court having jurisdiction, be subject to a fine of not more than
$500 or imprisonment for a term of not more than 90 days, or both.
