All sewage disposal systems hereafter constructed or repaired within the Township of Montague shall be done in accordance with the Standards for the Construction of Individual Subsurface Sewage Disposal Systems, effective July 1, 1978, New Jersey State Department of Environmental Protection. A copy of those standards is made a part of this chapter without inclusion of the entire text herein. Three copies of those standards are on file with the Clerk of the Township of Montague.
The code established and adopted by this chapter is described and commonly known as the "Standards for Construction of Individual Subsurface Sewage Disposal Systems, effective July 1, 1978."
Three copies of the Standards for the Construction of Individual Subsurface Sewage Disposal Systems have been placed on file in the office of the Clerk of the Township of Montague and in the office of the Secretary to the Board of Health and will remain on file in those offices for use and examination by the public.
A. 
No person shall locate, construct or alter any sewage disposal system until a permit for the location, construction or alteration of said sewage disposal system has been issued by the Board of Health.
B. 
The Board of Health may issue a permit if an application for the same is accompanied by a certificate made by an engineer licensed to practice professional engineering in the State of New Jersey stating that the design of the individual sewage disposal, as proposed, is in compliance with the applicable codes.
No individual disposal system shall be placed in operation nor a new dwelling, building or addition occupied or a repaired system placed in operation until the Board of Health or its designee shall have issued a certificate indicating that the system has been located and constructed in accordance with the terms of the permit and in accordance with the requirements of the applicable code.
In case any permit or certification required by this chapter is denied by the Board of Health, a hearing shall be held thereon before the Board within 15 days after a written request therefor is made by the applicant to the Board of Health. At the hearing the Board of Health shall affirm, alter or rescind its previous determination and take that action within 15 days after the date of the hearing.
A. 
The size of a disposal field shall be calculated on the basis of both soil percolation testing and the texture of the soil in which the field is to be constructed. The more restrictive results shall be used.
B. 
Absorption area based on percolation testing shall be determined according to N.J.A.C. 7:9-2. Absorption area (square feet) based on soil texture shall be determined by dividing the design flow in gallons per day (gpd) by the loading rate (gpd/square foot) for the soil texture group as shown in the following table:

C. 
The minimum design flow for individual dwellings shall be 300 gpd for three bedrooms or less and 400 gpd for four bedrooms.
A reserve area shall be provided which is capable of supporting a second disposal field meeting all requirements, whenever the system is designed to support three or more dwelling units.
Trenches shall be the preferred type of disposal field. Other types of disposal field may be used where a trench system would be clearly inappropriate to site conditions.
The Board of Health hereby endorses the Innovative and Alternative Technology Guide for On-site Wastewater Disposal in Sussex County, New Jersey, published June 22, 1982, by the Sussex County Water Quality Management Program, 55 High Street, Newton, New Jersey 07860. The township expects on-site system designers and installers to observe practices specified in the guide.
The Board of Health may order all further work in and about any individual sewage disposal system which is being erected or installed in violation of the code to be stopped forthwith, except for such work as shall be necessary to remedy such violation and, thereafter, the work continued without any violation of any of the provisions of the code; and after the issuance of any such order, no further work shall be done on any disposal system except as aforesaid.

The following fees and charges are established.
A. 
For the filing of an application and plans for a permit to locate and construct a sewage disposal system, there shall be a base fee of $125 for all systems up to 1,000 square feet of disposal area. There shall be an additional fee of $10 per 100 square feet of disposal area in excess of 1,000 square feet.
B. 
For filing of an application and plans for permits to repair or alter an existing sewage disposal system, there shall be a base fee of $60. There shall be an additional fee of $10 per 100 square feet of disposal area in excess of 1,000 square feet which is altered or repaired.
C. 
For each reinspection of a sewage system, or part thereof, caused by the failure of the permitee to locate and construct or alter the same in accordance with the terms of the permit or by the failure to be ready for inspection requested, a reinspection fee of $40 shall be charged.
Any person or persons, firm or corporation violating any provision of this chapter or any order promulgated under this chapter or any standard promulgated hereunder, upon conviction, shall pay a penalty of not more than $500 for each violation. Each day a particular violation continues shall be a separate offense.
All permits shall be valid for a period of one year from the date of issuance.
