No person or persons, firm or corporation shall, for any price,
gain or reward, exhibit or cause to be exhibited in the Township of
West Deptford any traveling or other shows, circus, carnivals or menagerie,
or cause to be given any exhibitions of whatsoever nature, or cause
to maintain or conduct any outside show, carnival, circus, menagerie
or other performance, and the governing body of the Township of West
Deptford is hereby prohibited from issuing any permits for such shows,
carnivals, circus or menagerie; provided, however, that the provisions
of this chapter shall not apply to a concert, musical, theatrical
performance, minstrels or other entertainment to be held indoors or
outdoors when operated by fire companies, veterans' associations,
churches or other civic associations for charitable or benevolent
purposes; provided, further, that any charitable institution may maintain
its own private concerts, musicals, theatrical performances or minstrels
where the said concessions and other games are under the direct supervision
of the members of the said organization or its duly authorized agents
and representatives.
The Chief of Police and the Police Department of the Township of West Deptford shall be the enforcement agency charged with the duty of enforcing the provisions of this chapter in accordance with the procedures and standards set forth in Chapter
51, Police Department.
No owner, occupant or other person or persons having the possession
or care of any house, building or room or any lot of land within the
Township of West Deptford shall suffer or permit any such traveling
show, carnivals or other shows, circus or menagerie, theatrical variety
performance, play, concert or other entertainment of a like nature
to be exhibited, acted or shown forth or performed, for any price,
gain or reward, on or upon his, her or their house, building or room
or lot of land, unless the said concessions or other amusements shall
be under the direct control and supervision of the members of the
charitable organization in the Township of West Deptford.
Any charitable organization which contemplates the showing,
exhibiting or action of any such concessions or other outdoor amusements
shall first obtain a permit therefor, which said permit shall be granted
by the Township Clerk with the approval of a majority of the governing
body.

The application for such a permit shall be made to the Township
Clerk in writing and signed by the applicant and shall state the name
of the charitable organization making such application and the place
where the proposed amusements are intended to be shown or performed
and any other information which may appear to be necessary for the
purpose of determining whether or not the permit applied for ought
to be granted. No fee shall be required with said application.

The Township Committee shall have the authority to revoke any such permit of any person not conducting amusements or concessions to its satisfaction, after reasonable notice to the person or persons, firm or corporation holding such permit and where satisfactory proof has been submitted to the Township Committee that the concessions or other amusements are in violation of §
138-1.
