Effective immediately upon the adoption of these Articles, it
shall be unlawful for any person, firm, corporation or business entity
to utilize or use a privately owned parking area, open to the public
and to which the public is invited, whether as a primary use or as
a secondary use, within borough limits unless it meets the following
regulations:
A. The sizes of all parking spaces and aisles shall be in accordance with Section
111-13 of this Code. This section shall not apply to motor vehicle dealers.
B. All parking areas shall be striped (painted). All vehicles shall
park only in designated areas and between the painted lines provided
and maintained by the owner of the property. This section shall not
apply to motor vehicle dealers.
C. Parking areas shall be kept clean at all times and shall include
waste disposal bins, to minimize littering at the property.
D. No parking space shall be located within five feet of any property
line.
E. A five-foot landscaped buffer shall be provided between any parking
area and any adjoining residential use.
F. No vehicle parked in a privately owned parking area shall obstruct
the passage of pedestrian traffic on any sidewalk in the borough.
This provision shall be enforced as a violation of the Property Maintenance
Code by the Code Official or duly authorized representative notwithstanding
the penalties provided in N.J.S.A. 39:4-138 as to the operator of
the vehicle.
G. No pits, racks, lifts or repair work shall be permitted out-of-doors
in any parking area.
H. No disabled vehicles shall be permitted to remain on the premises
for more than four weeks and no more than four disabled vehicles shall
be stored or parked on the premises.
I. No vehicles shall be placed or parked on unpaved areas.
J. All unpaved areas shall be planted and maintained with grass, trees
or shrubs.
The Police Department and/or Code Official or his designee may
enter upon lands and shall inspect and enforce all of the provisions
of this Article.
Whenever the Police Department and/or Code Official or his designee,
by inspection or otherwise, discovers a violation of this Article,
notice in writing shall be given to the owner of the premises to abate
the same within the time specified in such notice.
No building permit, certificate of occupancy and/or certificate
of compliance shall be issued for any building unless the Borough
Engineer and Construction Official have determined that the parking
area meets the provisions of this chapter, or the specific terms of
a Land Use Board resolution relating to the property on which the
parking area is located.
Site plan approval from the Land Use Board is required for any
exception from this Article except for a pre-existing motor vehicle
dealer possessing a valid mercantile license as of the effective date
of this Article.
Any person, firm, corporation or business entity that violates the provisions of this Article shall be subject to a penalty as provided for in Chapter
1 of the Code of the Borough of Neptune City for each day of such violation.
