This article shall be known and may be cited as the "Western Cumberland Council of Governments Membership Ordinance."
The background of this article and the legislative intention of the Council in enacting it are as follows:
A. 
The Borough is a separate and distinct body politic organized under the Borough Code[1] of Pennsylvania.

B. 
The Act of December 19, 1996, P.L. 1158, No. 177, referred to as the "Intergovernmental Cooperation Law," 53 Pa.C.S.A. § 2301 et seq., provides that two or more municipalities may jointly cooperate in the exercise or in the performance of their respective governmental functions, powers and responsibilities.
C. 
The Western Cumberland Council of Governments (WCCOG) was formed to provide a regional resource for local municipalities in the western portion of Cumberland County to cooperate and jointly exercise governmental functions.

D. 
The Council finds that it is in the best interest of its citizens to join the Western Cumberland Council of Governments to participate in cost savings in purchases and to share in the use of municipal resources.

The conditions of membership, duration, purpose and objectives of the WCCOG, including the powers and scope of authority delegated therein, manner and extent of financing, organizational structure necessary to implement the WCCOG and manner in which property will be acquired, managed and disposed of are set forth in the bylaws of the WCCOG as amended from time to time.
The President of the Borough Council of the Borough of Mount Holly Springs is hereby authorized to complete all documents and perform all actions necessary to obtain membership in the Western Cumberland Council of Governments.
A. 
If any sentence, clause, phrase or section of this article is for any reason found to be unconstitutional, illegal or invalid, such unconstitutionality, illegality or invalidity shall not affect or impair any of the remaining provisions, sentences, clauses, phrases, sections or parts of this article.
B. 
It is hereby declared as the intention of the Borough Council that this article would have been adopted had such unconstitutional, illegal or invalid sentence, clause, phrase, section or part thereof not been included therein.
Any other ordinance or parts thereof inconsistent with this article be and are hereby expressly repealed.
This article shall become effective as provided by law.
