The City of O'Fallon, Missouri, shall be authorized to make,
adopt, amend, extend, and carry out a comprehensive plan as authorized
by law.

A Commission to be known as "Planning and Zoning Commission"
is hereby created which shall consist of: 1) the Mayor, if the Mayor
chooses to be a member of the Commission; 2) a member of the City
Council selected by the City Council, if the City Council chooses
to have a member serve on the Commission; and 3) eleven (11) citizen
members appointed by the Mayor with the approval of the City Council
such that two (2) members are representing each ward and one (1) citizen
member shall serve at large. The eleven (11) citizen members shall
be compensated in the amount of twenty-five dollars ($25.00) per meeting
attended up to two hundred dollars ($200.00) per month.

The Planning and Zoning Commission shall elect its Chairperson
and Vice Chairperson from among the citizen members. The term of Chairperson
and Vice Chairperson shall be for one (1) year with eligibility for
re-election. The term of each of the citizen members shall be for
four (4) years, except that the terms of the citizen members first
appointed shall be for varying periods so that succeeding terms will
be staggered. The terms of all members and the terms of office for
the Chairperson and Vice Chairperson shall expire on April 30 of the
appropriate year and when a successor is appointed and qualified.
Any vacancy in a membership shall be filled for the unexpired term
by appointment as aforesaid. The City Council may remove any citizen
member for cause stated in writing and after public hearing.

The Planning and Zoning Commission shall hold regular meetings
and special meetings as they provide by rule. The Commission shall
adopt rules for the transaction of business and shall keep a record
of its resolutions, transactions, findings and determinations, which
record shall be a public record. Any member of the Planning and Zoning
Commission who within any twelve (12) month period has three (3) unexcused
absences or a total of five (5) absences, shall be subject to immediate
removal by the Mayor for neglect of duty unless there are extenuating
circumstances. Any member being more than thirty (30) minutes late
to a meeting shall be charged with one-half (1/2) of an unexcused
absence.

The City Council may provide the funds, equipment and accommodations
necessary for the work of the Commission, but the expenditures of
the Commission, exclusive of gifts, shall be within the amounts appropriated
for that purpose by the City Council and no expenditures, nor agreements
for expenditures shall be valid or legal in excess of such amount.

It shall be the function and duty of the Commission to make and adopt plans for the physical development of the municipality, including any area outside of its boundaries but within its statutory authority which, in the Commission's judgment, bear relation to the planning of the municipality, including site plans as provided in Article
XIV of this Chapter.

A. The Commission, from time to time, shall recommend to the appropriate
public officials programs for public structures and improvements and
for the financing thereof. It shall be the function and duty of the
Commission to further consult and advise with public officials and
agencies, civic organizations, public utility companies, educational,
professional and other organizations and with citizens with relation
to the promulgation and carrying out of the plan. The Commission shall
have the power to delegate authority to any of the above named groups
to conduct studies and make surveys for said Commission if it deems
expedient.
B. The Commission shall, from time to time, review applications, issue reports, and make recommendations to the Mayor and City Council on amendments to the Zoning Map, as provided in Article
XVI, Planned Unit Developments, as provided in Article
V, and all other powers and duties ascribed to them by this Chapter.
