A.
No person shall willfully or maliciously:
(1)
Torture, cruelly beat, injure, maim, mutilate, or unjustly destroy
or kill any animal belonging to himself or to another;
(2)
Deprive any animal in subjugation or captivity of food generally
accepted as being nutritious, potable drinking water, adequate shelter
or exposed to unsanitary, diseased conditions, or other inhumane care;
(3)
Unjustly administer any poison or noxious drug or substance to any
animal;
(4)
Unjustly expose any drug or substance with the intent that the same
shall be taken by an animal, whether such animal be the property of
that owner or another person;
(5)
Overwork, overload, or work while in an injured condition any animal
belonging to himself or to another;
(6)
Instigate or allow combat between animals or between animals and
humans;
(7)
Cause any other person to do any of the above items.
No person shall expose any poisonous substance in a residential
area where the same may constitute a hazard to humans or domestic
animals in the neighborhood.
No person shall willfully torture, torment, beat, mutilate,
injure, disable, or otherwise mistreat a police dog owned by a law
enforcement agency of the state or political subdivision of the state.
No person shall willfully interfere with the lawful performance of
any police dog. No person shall harass, bother, annoy, or provoke
a police dog owned by a law enforcement agency of the state or political
subdivision of the state. Any person convicted of violating this section
shall be punished by a fine as set by resolution.
A.
No person shall own, keep, or harbor any animal that is a public
nuisance animal.
B.
If an animal is found by the Municipal Court judge, upon notice and
hearing, to be uncontrollable by its owner to the extent that such
animal poses a threat to the health, safety, and welfare of the public,
then such animal shall be ordered removed from the City limits or
destroyed, at the owner's option, within 10 days of the order.

Such a finding by the Municipal Court judge shall be based upon, but not limited to, evidence of three convictions, pleas of guilty, or nolo contendere of violations of Subsection A or § 135-22 of this chapter against or by the current owners within a twelve-month period concerning the same animal, or two convictions, pleas of guilty, or nolo contendere of violations of §§ 135-26, 135-27, and 135-28 of this chapter against or by the current owners within a twelve-month time period concerning the same animal.
A.
All pens or enclosures for animals shall be maintained in a clean
condition and be free of filth. All manure shall be cleaned daily
from the pens, and if kept in a manure pile, such shall be removed
at least twice weekly.
B.
Each pen and enclosure shall be sprayed with a suitable residual
spray as often as is necessary to control flies, insects, and noxious
odors.
A.
The owner or keeper of any animal, which has died, shall be responsible
for disposal of its body and all cost and fees associated with the
disposal of the animal.
B.
Any person who knows the location of a dead animal within the City
limits shall give immediate notice to the Animal Control Officer or
Police Department. The proper authority shall cause the dead animal
to be removed within 24 hours after receiving such notice.
C.
The owner or keeper of any animal which has died and requires its
removal or disposal by an Animal Control Officer or any other City
employee shall be responsible for all costs associated for the disposal
of the animal and subject to service fees as set by Resolution.
A.
As a courtesy, Animal Control Officers may pick up and transport
private small animal traps from any residence within the City limits
of El Reno to the El Reno Animal Shelter in order to dispose of an
animal. Animal Control Officers shall return traps as soon as practical
or require the owner to pick up the trap from the animal shelter.
Animal Control Officers shall not pick up or transport any private
animal traps where the owner does not sign or have on file with the
City a release of liability for any damage to his or her animal traps.
B.
Animal Control Officers shall not transport any private small animal
trap larger than the dimensions of 24 inches by 36 inches by 12 inches
or weighing more than five pounds when empty.
C.
Animal Control Officers may loan City-owned live traps to citizens
of the City if such traps are available upon completion of the required
procedure as set forth by the Animal Control Supervisor.
A.
No person owning or having charge or custody of a maimed, diseased,
disabled, or infirm animal shall abandon said animal or allow said
animal to lie in a public street, road, or public place one hour after
receiving notice by a duly constituted authority that the animal is
disabled or dead.
B.
Any Police Officer or Animal Control Officer may impound, destroy,
or cause to be destroyed any animal found abandoned and for which
no proper care has been given.
C.
When any person who is arrested, and who is at the time of such arrest
in charge of any animal or of any vehicle drawn by or containing any
animal, any Police Officer, Animal Control Officer, or agent or officer
of said humane societies may take custody of the animal or of the
vehicle and its contents, or deliver the animal or the vehicle and
its contents into the possession of the Police Chief, who shall assume
the custody thereof. All necessary expenses incurred in taking custody
of the animal or of the vehicle and its contents shall be a lien on
such property.
