Pursuant to Village Law § 7-728, the Planning Board is authorized to review and approve, approve with modifications or disapprove all plat subdivision plans, site plans for the construction of new single-family residences, special permits pursuant to § 200-83, wetland and steep slope permits pursuant to § 200-93, driveway curb cut plans, and any plans as listed in other sections of this code. The Planning Board shall also review all plans referred from the Village Board and Zoning Board, and the Planning Board's scope in these referrals shall be for the purpose of review and comment only. The plans shall show the arrangement, layout and design of the proposed use of the land shown on such plan. The uses for which such approval shall be required are residential and commercial. The elements to be included in such plans submitted for approval shall include those relating to parking, means of access, screening, signs, landscaping, architectural features, location and dimensions of building, impact of the proposed use on adjacent land uses and such other elements as may reasonably be related to the health, safety and general welfare of the community.

The approval of all plans by the Planning Board as authorized in § 36-1 herein is a condition precedent to the issuance of a building permit.

Final approval of nonresidential site plans shall remain with the Board of Trustees.

In the event that the applicant fails to begin construction of the structure within 12 months from the date of final approval by the Planning Board or the Board of Trustees, said approval shall be deemed null and void, unless said approval is extended by the Planning Board or Board of Trustees upon good cause shown.
