The Board of Trustees of the Village of Ardsley believes that the recycling of newspapers, glass and metal containers and corrugated paperboard will prevent wasteful incineration, lower the village's charges for refuse disposal, provide an additional revenue stream to the village and will help to conserve natural resources. Mandatory recycling of newspapers, glass and metal containers and corrugated paperboard will remove a significant tonnage of material from the solid waste stream and divert it to a recyclable use. It is the purpose of this chapter to institute a program of mandatory recycling for specific recyclable materials in an attempt to derive maximum environmental and economic benefit with minimum inconvenience to residents and property owners.
A. 
The owners, lessees or occupants of all structures within the village who receive refuse collection services from the Village of Ardsley shall package newspapers, glass and metal containers and corrugated paperboard for collection and recycling by the Department of Public Works or its duly authorized agent.
B. 
Newspapers shall be securely bundled and tied with rope or cord in packages or placed in nondisposable containers, not exceeding 50 pounds in weight per package or container. Paper in plastic or paper bags cannot be accepted. Only clean newsprint can be accepted; no other type of paper should be included in the package or container. "Clean newsprint" is defined as newsprint in substantially the same condition as originally received, absent normal wear and tear, and free from paint, stain, garbage or other extraneous materials.
C. 
Clear, green and brown glass shall be rinsed clean, with caps and lids removed, and placed in sturdy, nondisposable containers. Metal food, juice and beverage cans shall be rinsed clean, with any caps or lids removed, and placed in a sturdy, nondisposable container. These items may be commingled in the same container, but only the items listed herein may be included in the container.
D. 
Corrugated paperboard shall be cut into pieces two by three feet maximum size. The corrugated paperboard shall be securely bundled and tied with rope or cord in packages or placed in nondisposable containers, not exceeding 50 pounds in weight per package or container. Corrugated paperboard in plastic or paper bags cannot be accepted.
E. 
Newspaper, glass and metal containers and corrugated paperboard bundles or packages placed in containers as noted in Subsections B, C and D shall, on the day of collection, be placed at curbside for collection or other authorized location.
F. 
Failure to separate newspapers, glass and metal containers and corrugated paperboard and to place such separated newspapers and corrugated paperboard at curbside for collection and recycling shall be considered a violation of this chapter.
A. 
With the exception of newspapers, glass and metal containers and corrugated paperboard placed at curbside in connection with the volunteer or charitable recycling drives, from the time of placement of newspapers, glass and metal containers and corrugated paperboard at the curb for collection by the Village of Ardsley or its authorized agent, pursuant to the rules and regulations herein contained or hereafter promulgated, such newspaper, glass and metal containers and corrugated paperboard shall become the sole property of the Village of Ardsley or its authorized agent.
B. 
It shall be a violation of this chapter for any person unauthorized by the Village of Ardsley to pick up or cause to be collected or picked up any such newspapers, glass and metal containers and corrugated paperboard.
If any provision of this chapter or the application thereof to any person or circumstances is adjudged invalid by a court of competent jurisdiction, such judgment shall not affect or impair the validity of the other provisions of this chapter or the application thereof to other persons and circumstances.
A. 
Any person, whether that person be owner, lessee or occupant, who violates any provision of this chapter or the rules and regulations established pursuant thereto shall, upon conviction thereof, be subject to a fine of not less than $50 nor more than $250.
B. 
Failure to comply with the terms of this chapter on subsequent collection days shall be considered a separate offense.
This chapter and any amendments thereto shall become effective 60 days after filing in the office of the Secretary of State.
