A code regulating the use, operation and maintenance of food and beverage vending machines and registration thereof; prohibiting the sale or possession with intent to sell through vending machines of adulterated or misbranded foods or drinks; authorizing inspection of vending machines and operations connected therewith; and fixing penalties for violations thereof is hereby established pursuant to N.J.S.A. 26:3-69.1 et seq. A copy of the code is annexed to this chapter and made a part of it without the inclusion of the text.
The code established and adopted by this article is described and commonly known as the "New Jersey State Sanitary Code, Chapter XII, Sanitation in Retail Food Establishments and Food and Beverage Vending Machines,"[1] in this article here and after known as "Chapter 12."

The provisions of the code N.J.A.C. 8:24-1.3 are amended to provide the definition of Health Authority as follows: "Health Authority" shall mean the duly licensed agent of the local Board of Health and/or State Department of Health to act in the enforcement of its ordinances and sanitary laws of the state and, for enforcement purposes, also shall mean and include regular and special patrolmen and superior officers of the Police Department, the Construction Code Official or any other official authorized by the City Council to enforce this code and article.

The annual registration fee to engage in the business of operating a food and/or beverage vending machine as defined in N.J.A.C. 8:24-11.1 et seq. shall be $30 for each machine each year.

The owner or operator of a food or beverage vending machine operating in the City of Long Branch shall submit an application on a form provided by the Department of Health of the City of Long Branch along with the fee of $30 for each food or beverage vending machine operated in the City of Long Branch; such fee and application are to be submitted to the City of Long Branch Department of Health by January 1 of each year. Any person intending to operate a food or beverage vending machine must submit the fee and application prior to beginning operation, provided that the Health Authority, upon proper application, may authorize waiving of the fee for a charitable, religious, governmental benevolent or other not-for-profit group or organization.
