The site, ground and building, and the deed and title therefor as executed by the said Howard E. Young and Martha E. Young, his wife, bearing date the 30th day of September 1911, and now tendered to the Mayor and Borough Council of the Borough of Hanover, Pennsylvania, be and the same are hereby accepted upon the terms and conditions and for the uses and purposes specified; and in further evidence of such acceptance, is hereby ordered and directed to be immediately recorded.
A public library be, and the same is, hereby established in the said building and upon the grounds and property so granted and donated by the said Howard E. Young and Martha E. Young, to be established, maintained, supported and improved out of any money or bequests now held or which may hereafter be acquired or received by the Borough of Hanover, or its successor, for library purposes; which moneys or bequests shall be applied and used by the Borough for the benefit of said public library in the same manner and under the same management and control as herein provided and stipulated with regard to the Dr. J. P. Smith Fund.
The whole of the fund received by the Borough from the estate of Dr. J. P. Smith be invested by the Borough and the income therefrom applied to the maintenance and management of the said library.
In the investment of the said Dr. J. P. Smith Fund and other funds or property acquired or received by the Borough of Hanover for library purposes, only such investment shall be made as shall be recommended by a Financial Commission, which is hereby created, consisting of three members, to wit: the President of the Hanover Savings Fund Society, or in case of his refusal or neglect to act, the Cashier or other proper officer acting in that capacity for said institution; the President of the First National Bank of Hanover, or in case of his refusal or neglect to act, the Cashier or other proper officer acting in that capacity for said institution; and the President of the People's Bank of Hanover, or in case of his refusal or neglect to act, the Cashier or other proper officer acting in that capacity for said institution; and in the event of the refusal or neglect of any of the aforesaid officers to act, then the vacancy or vacancies shall be filled, first, by the President of the Farmers' State Bank of Hanover, or in case of his refusal or neglect to act, the Cashier or other proper officer acting in that capacity for said institution; second, by a person or persons appointed by the Mayor of the Borough of Hanover, or his successor, and approved by the Borough Council of said Borough, or their successors, provided that such appointment so made by the Mayor to a vacancy in said Financial Commission shall only be for an unexpired term, and until a member from the class from which such Financial Commission is to be selected shall indicate by writing addressed to said Mayor his willingness to accept a position on said Commission and serve on the same.
The Mayor be directed to call upon the President of the Hanover Saving Fund Society, the President of the First National Bank of Hanover and the President of the People's Bank of Hanover for the purpose of requesting them to comprise said Commission; to recommend investments of the said fund, and that the Borough authorities adopt the recommendations of the said Commission.
In the use and maintenance of said public library, the Borough authorities shall adopt the recommendations (provided such recommendations are such as can be legally adopted) of a Library Governing Board, to be composed of nine members, three of whom shall be the Financial Commission, to be selected as provided in the above paragraph; three of whom shall be appointed by the Mayor of the Borough of Hanover, or his successor, and approved by the Borough Councils of said Borough, or their successors; and three of whom shall be appointed by the Hanover Public Library Association, a corporation created by decree of the Court of Common Pleas of York County, Pennsylvania, who shall be subject to the approval of said Borough Councils. The members to be appointed by the Mayor and the Hanover Library Association shall serve, one for one year, one for two years and one for three years, respectively, and until their successors shall be appointed, and their successors thereafter shall serve for the term of three years.
The term of office for the above-mentioned Financial Commission and Library Governing Board begins February 1, 1910.
