As used in this chapter, the following terms shall
have the meanings indicated:
ACCESSORY BUILDING
Secondary or subordinate to principal use, located on the
same lot and used for purposes customarily incidental to those of
the main building.
BUILDING
Any structure other than a boundary wall or fence.
EASEMENT
Authorization by a property owner for the use by another
and for a specified purpose of any designated part of his property.
LOT
A parcel of land occupied or capable of being occupied by
one building and accessory building and/or uses, including such open
spaces as are required by these subdivision regulations.
LOT DEPTH
The mean horizontal distance between the front and rear lot
lines, measured in general direction of the side lot lines.
LOT FRONTAGE
That property line of the lot which is contiguous with the
street line.
LOT FRONTAGE, CORNER
The front property line of a lot which faces two streets
shall be the narrowest street frontage or the direction that an occupied
structure upon said lot obviously faces.
LOT WIDTH
The width measured at right angles to its depth.
MASTER PLAN
A Comprehensive Plan prepared by the Planning Board pursuant
to § 272-a of the Town Law which shows general locations
desirable for the various functional classes of public works, places
and structures and other general physical developments of the Town,
and includes any unit or part of such plan separately adopted and
any amendment to such plan or parts thereof.
OFFICIAL MAP
The map established by the Town Board pursuant to §§ 270
and 273 of the Town Law, showing streets, highways and parks theretofore
laid out, adopted and established by law, and any amendment thereto
adopted by the Town Board.
OFFICIAL SUBMISSION DATE
The date when a subdivision plat shall be considered submitted to the Planning Board, as provided in § 276 of the Town Law and as hereby defined to be the date of a meeting of the Planning Board at which all required surveys, plans and data described in Article
IV are submitted.
ORDINANCE OFFICER
The person duly designated by the Planning Board who shall
be responsible as the agent of the Planning Board for the enforcement
of this chapter.
PRELIMINARY LAYOUT
The preliminary drawings and accompanying information of
the subdivider's plan of subdivision.
PRINCIPAL BUILDING
The main building located on a lot in which the principal
use is conducted. There shall be one "principal building" per lot.
SKETCH PLAN
Preapplication drawing of subdivision submitted to the Planning
Board.
STREET
Includes streets, roads, avenues, lanes or other ways.
STREET PAVEMENT
The wearing or exposed surface of the roadway used by the
vehicular traffic.
STREET WIDTH
The distance between property lines or boundary lines which
define the public way.
SUBDIVIDER
Any person or entity who shall lay out, for the purpose of
sale or development, any subdivision or part thereof, as defined herein,
either for himself or others.
SUBDIVISION or SUBDIVIDE
Any tract of land which is divided into five or more parcels
along any existing or proposed street(s), highway(s), easement(s)
or right(s)-of-way for sale or for rent as lots or building plots,
regardless of whether the lots or plots to be sold or offered for
sale or leased for any period of time are described by metes and bounds
or by reference to a map or survey of the property or by any other
method of description and regardless of whether the lots or plots
are contiguous. A tract of land shall constitute a "subdivision" upon
the sale, rental or offer for sale or lease of the fifth residential
lot or residential building plot therefrom within any consecutive
three-year period and shall apply to all such parcels thereof, including
the first four parcels, regardless of whether said parcels have been
sold, rented or offered for sale or lease singly or collectively.

SUBDIVISION PLAT
The final map, drawings or chart on which the subdivider's
plan of subdivision is presented to the Planning Board for final approval
and which, if approved, will be submitted to the County Clerk for
recording.
TRACT
Any body of land, including contiguous parcels of land, under
one ownership or under a common control of any group of persons acting
in concert as part of a common scheme or plan. (NOTE: The preceding
definition of "tract" is identical to the definition of "tract" contained
in § 1115, Subdivision 2, of the New York State Public Health
Law.)
ZONING ORDINANCE
The officially adopted Zoning Ordinance of the Town, together
with any and all amendments thereto.
