This article is enacted pursuant to the authority granted by Subdivision 1, § 10 of the Municipal Home Rule Law.
A. 
The Town of Chenango finds that due to the lack of rain and extreme drought conditions throughout the Town there is a chance of depletion of public and private water supplies that will endanger the health and welfare of the residents of the Town of Chenango.
B. 
It is the purpose of this article to create one standardized procedure for securing legal and equitable remedies relating to the subject matter encompassed by this article without prejudice to the use of procedures available under existing or subsequently enacted laws and to strengthen existing laws on the subject.
During the period of an emergency declared by the Town Board and/or the Supervisor of the Town of Chenango or his or her designated agent, the use of water from water mains or private water supplies within the Town of Chenango for the following activities shall be considered a waste of water and shall be prohibited within the meaning of this article:
A. 
Washing cars by means of a hose.
B. 
Washing cars at a dealership, except in preparation for immediate sale.
C. 
Watering established lawns.
D. 
Watering gardens, newly-seeded lawns, flowers, trees or shrubbery, except during the hours from 7:00 p.m. until midnight or 5:00 a.m. to 8:00 a.m., with a hand held hose with a spray nozzle or water can.
E. 
Washing houses, patios, driveways, walkways, etc., unless in preparation for painting.
F. 
Automatically serving water to patrons in restaurants.
G. 
Watering of athletic fields.
H. 
Watering of golf courses, except for greens, tees and aprons or ground under repair.
I. 
The operation and filling of swimming pools, portable or otherwise, except pools designed and used exclusively for medical treatment.
The Town Board and/or Supervisor or his or her designated agent may declare an emergency after the recommendation and report of the Water and Sewer Superintendent that the water levels of public or private well systems are at the level where water conservation is required or the Water and Sewer Superintendent reports a serious and substantial equipment failure that jeopardizes the public water supply system.
Violation of provisions of this article shall be punishable by a fine, to be fixed by the Court, not to exceed $250 for the first offense and $500 for any subsequent offenses or by imprisonment not to exceed five days, or by both fine and imprisonment. In addition, the public water supply may be cut off by the Town of Chenango Water Department.
