For the purpose of this article, the following
words and phrases shall have the meanings respectively ascribed to
them by this section:
BOARD OF REVIEW
A board to consist of five members to be appointed by the
Village Manager with the approval of the Council, to hear and dispose
of appeals in accordance with the provisions of this article.
PLACE
Any plot, lot, house, garage, barn building or structure
of any kind or nature.
WILD ANIMAL
An animal of a species dangerous to human beings or savage
in nature, living ordinarily at large and not customarily made tame
or gentle by long continued association with man, without regard to
whether a specific animal is considered a pet or domesticated by its
keeper or possessor.
The purpose of this article is to prohibit the
keeping or harboring of wild animals within the Village in order to
protect the health and general welfare of the populace of the Village
and to keep public order and to prevent riot and panic in case of
fire or other emergencies.
No person shall hereafter keep, maintain, harbor
or have in his possession any wild animal in, at or upon any premises
or place owned, leased or otherwise occupied by him within the Village.
No person shall hire, lease or occupy any place within the Village
for the purpose of keeping or maintaining or harboring any wild animal.
There is hereby created a Board of Review to hear and dispose of all appeals from the classification of wild animal. The Board is to consist of five members to be appointed by the Village Manager with the approval of the Council. Any person desiring to appeal from the classification of wild animal shall, within 15 days from the date of notice of such classification, file a notice of appeal, in writing, with the Board of Review. The Board of Review shall convene for the purpose of considering such appeal within 45 days from the date of receipt of the notice of appeal. Notice of the hearing of such appeal shall be made by certified mail at least 10 days prior to the hearing to the person aggrieved at the post office address shown on the notice of appeal. The Board of Review shall render a decision within 30 days from the date of the hearing and cause notice thereof to be sent by certified mail to the person aggrieved. In the event of a decision adverse to the appellant, the wild animals shall be caused to be removed from the Village within 30 days of the date of mailing of such notice from the Board of Review. In considering all appeals pursuant to the provisions of this article, the Board of Review shall be governed by the definitions provided in §
105-34 as well as the purposes set forth in §
105-35.
