A. 
Whenever an emergency condition or situation has developed or is to occur in the Village, as determined by the Village Manager in consultation with the Village Office of Emergency Management and the Village Chief of Police, the Village Manager shall have the sole authority to designate "No Parking Areas." Such designation can be applicable Village-wide or to specific streets or areas. When the "No Parking Areas" are designated by the Village Manager, they shall mean that no vehicle shall be parked on either side of any such street or parts thereof until such time the emergency condition is deemed ended. Duration of the "No Parking Areas" shall be determined by the conditions that warranted the designation.
B. 
The above parking prohibitions shall remain in effect until after the emergency condition or situation has ceased. In the event of a snow or ice incident, the parking prohibitions shall remain in effect until the streets have been plowed sufficiently and to the extent that vehicle parking will not interfere with the normal flow of traffic.
C. 
Any person in violation of the provisions of § 265-43, of Article VI, Designation of emergency no-parking areas, shall be liable to the following penalties, in addition to having his/her vehicle being towed:

A. 
Upon the declaration of an emergency, there shall be no parking upon streets or parts of streets where temporary emergency no-parking signs are displayed. The Chief of Police, or in his absence the ranking police officer, is authorized to declare an emergency and to direct the posting of said emergency no-parking signs when weather conditions, accidents, fires or public celebrations dictate or require the avoidance of hazards or other conditions which interfere with the free flow of traffic.
B. 
Notification that the emergency no-parking signs are being or will be posted shall be given to the operator or owner of any vehicle which has been parked prior to the posting of the signs.
Any unoccupied vehicle parked or standing in violation of this article shall be deemed a nuisance and a menace to the safe and proper regulation of traffic, and any peace officer may provide for the removal of such vehicle. The owner shall pay the reasonable costs of the removal and storage which may result from such removal before regaining possession of the vehicle.

The effectiveness of this article is contingent upon signs being erected as required by law, however that does not relieve a person parking a vehicle from paying the required parking fee via one of the approved methods.
