The Borough Council of the Borough of Mount
Pocono hereby signifies its intention and desire to organize an Authority
under the provisions of the “Municipality Authorities Act of
1945” (Act of May 2, 1945, P.L. 382), as amended.[1]

The Mayor, the President of the Borough Council
and the Secretary of the Borough Council are hereby authorized and
directed to execute, on behalf of the Borough of Mount Pocono, Articles
of Incorporation in substantially the following form.[1]

The first members of the Board of Mount Pocono
Municipal Authority named in the proposed Articles of Incorporation
are hereby specifically appointed members of said Board for the terms
of office set after their respective names, which terms shall commence
on the date of approval hereof and shall be computed from January
1, 1973.
The proper officers of the Borough are hereby
directed to cause a notice of this article to be published one time
in the Monroe Legal Reporter, the legal periodical of Monroe County,
and one time in the Pocono Record, a newspaper published and of general
circulation in Monroe County, as required by the Municipality Authorities
Act of 1945, as amended;[1] to file said Articles of Incorporation, together with
the required proofs of publication of notice of this article and a
certified copy of this article with the Secretary of the Commonwealth;
and to do, execute and perform any and all official acts, and to pay
all fees and costs necessary or appropriate to effect the incorporation
of Mount Pocono Municipal Authority.

This Authority is organized for all of the purposes
and shall have all of the powers set forth in the Municipality Authorities
Act of 1945, as amended;[1] provided however, that it shall undertake only those projects
specifically authorized by ordinance of the Borough Council of the
Borough of Mount Pocono.

The first projects of this Authority shall be
as follows:
A.
To acquire, hold, construct, improve, maintain, and
operate a sewer system and sewerage treatment works and property and
equipment for use in connection therewith for the Borough of Mount
Pocono and for such other territory as it may be authorized to serve.
B.
Also to acquire, hold, construct, improve, maintain,
and operate a water supply system and property and equipment for use
in connection therewith for the Borough of Mount Pocono and for such
other territory as it may be authorized to serve.
