[HISTORY: Adopted by the Borough Council of the Borough of Mount Pocono 3-1-1999 by Ord. No. 3-1999. Amendments noted where applicable.]
The Borough of Mount Pocono finds that the improper use of laser beam pointer devices is proliferating and constitutes a hazard to the health, safety, and welfare of the citizens of the Borough of Mount Pocono. Such laser beam pointer devices carry a warning that laser beams can cause retinal damage from contact with the eye. The Borough Council wishes to prohibit the improper use of such devices in the Borough of Mount Pocono.
As used in this chapter, the following terms shall have the meanings indicated:
LASER BEAM POINTER DEVICE
Any device which emits a laser beam or light.
A. 
It shall be unlawful for any person in the Borough of Mount Pocono to focus, point, or shine a laser beam directly or indirectly upon another person or animal as to such a manner as to cause harassment, annoyance or injury to such person or animal.

B. 
It shall be unlawful for any person to focus, point or shine a laser beam in any movie theater, restaurant, or other public gathering place within the Borough of Mount Pocono.
Any person, firm or corporation who violates any provision of this chapter shall, upon conviction therefor, be subject to a fine not exceeding $1,000, plus costs of prosecution, and, in default of payment of such fine and costs, to imprisonment for not more than 30 days.
