Hunting game of any kind within the Borough
limits is prohibited.
As used in this chapter, the following terms
shall have the meanings indicated:
The pursuit of any wild game or other animal for the purpose
of killing such game or other animal with any device, including firearm,
bow or other such device.
Any person who shall violate any of the provisions
of this chapter shall, upon conviction in a summary proceeding brought
in the name of the Borough of Mount Pocono before a District Justice
in the same manner provided for the enforcement of summary offenses
under the Pennsylvania Rules of Criminal Procedure, be sentenced to
pay a fine of not more than $1,000, and costs of prosecution and restitution,
and shall be subject to imprisonment for not more than 30 days, provided
that each day’s violation of any of the provisions of this chapter
shall constitute a separate offense.
In addition to any of the remedies provided
above, any continual violation of this chapter shall be considered
a nuisance and the Borough of Mount Pocono may seek to abate said
nuisance by instituting appropriate legal proceedings.
