As used in this chapter, the following terms
shall have the meanings indicated:
ROLLER SKATES, IN-LINE SKATES or ROLLER BLADES
Any recreational device consisting of a set of two wheeled
platforms, whether or not permanently affixed to a pair of shoes or
boots, and regardless of the configuration of the wheels thereon,
designed to be worn on the user's feet and used to propel the user
in a manner similar to ice skates.

SCOOTER
Includes every device propelled by human power, having one
or more wheels affixed to a board or platform upon which any person
might ride, stand, or sit and having handlebars or a similar device
designed for steering. This definition shall not include bicycles.
SKATEBOARD
Includes every device propelled by human power, having one
or more wheels affixed to a board or platform upon which any person
might ride, stand or sit. This definition shall not include bicycles.

All persons operating skateboards, scooters,
roller skates or in-line skates (often known as “roller blades”)
and other similar devices on any public street, alley, highway, sidewalk,
public parking lot, or upon Borough property within the Borough of
Mount Pocono shall be subject to the following regulations:
A. No person shall ride or operate a skateboard, scooter,
roller skates or in-line skates (often known as “roller blades”)
or other similar device upon any public street, alley, highway, or
public parking lot within the Borough of Mount Pocono.
B. No person shall ride or operate a skateboard, scooter,
roller skates or in-line skates (often known as “roller blades”)
or other similar device upon any sidewalk located adjacent to any
of the following roadways:
C. Skateboards, scooters, roller skates or in-line skates
(often known as “roller blades”) or other similar devices,
where permitted, may only be used in the Borough of Mount Pocono during
daylight hours.
D. No person shall operate a skateboard, a scooter, roller
skates or in-line skates (often known as “roller blades”)
or similar device while hanging onto another vehicle (including a
bicycle, another skateboard, scooter or similar device, or a motorized
vehicle).
E. No skateboard ramp shall be constructed, used or maintained
on any sidewalk.

All operators of skateboards, scooters, roller
skates or in-line skates (often known as “roller blades”)
and other similar devices shall yield the right-of-way to pedestrian
traffic by not operating said device within 20 feet of any pedestrian
and shall otherwise operate such devices in a reasonable and safe
manner.
Any person violating any provisions of this
chapter shall, upon conviction thereof before any District Justice,
be sentenced to pay a fine of not more than $1,000, plus costs of
prosecution, and, in default of payment of such fine and costs, to
imprisonment for not more than 30 days, provided that each violation
shall be separately and successively subject to conviction at penalty.
