The following regulations shall apply in the RM-ML16 Zone only in accordance with the terms of a fully executed mediation agreement which has been approved by the Council on Affordable Housing and placed on file with the Brick Township Clerk.
The following uses are permitted in the RM-ML16 Zone:
A. 
Multifamily attached housing inclusionary rental or garden apartments, provided that at least 20% of the dwelling units shall be affordable to low- and moderate-income households in accordance with Article V, Affordable Housing.

B. 
On-site manager's office serving multifamily rental attached or garden apartment development.
A. 
The maximum density permitted shall be 16 dwelling units per acre or buildable land in accordance with § 245-3 of this chapter.
B. 
The maximum length of any building shall be 200 feet and the maximum depth of any building shall be 85 feet. The minimum distance between buildings shall be 25 feet where the facing vertical planes contain no windows or are at a minimum placed at a fifteen-degree angle. The minimum distance between the buildings shall otherwise be 40 feet.
C. 
No portion of any dwelling unit shall be lower than the outside finished grade. No depressed siting shall be permitted.
D. 
There shall not be more than 30 units in each building.
The following are permitted as accessory uses:
A. 
Accessory uses as defined in Part 1 of this chapter.
Area, yard and building requirements shall be as follows:
A. 
Minimum lot size:
(1) 
Area: one acre.
(2) 
Width: 350 feet.
(3) 
Depth: 200 feet.
B. 
Minimum required yard setback:
(1) 
Front yard along Old Squan Road: 60 feet.
(2) 
Along Route 70: 25 feet.
(3) 
Side yard: 25 feet.
(4) 
Accessory building (side and rear): 25 feet.
C. 
Maximum lot coverage with building: 30% of gross lot area.
D. 
Maximum height: two stories; 35 feet.
E. 
Minimum building setback from parking area or internal access road: 10 feet.
F. 
Maximum second floor overhang into setback line: three feet.
Off-street parking space, together with appropriate access thereto, shall be provided on the same lot as the building it is intended to serve in accordance with the standards set forth in Article XXXV, § 245-310 et seq., except as follows:
A. 
The minimum number of parking spaces shall be 1.5 for each one-bedroom unit and two for each two-bedroom unit.
B. 
The minimum size for a parking space shall be nine by 18 feet with an access aisle of 24 feet between each row of parking stalls, provided that at least two feet of length overhang which does not encroach upon sidewalks or walkway is provided. In the event that said two feet of length overhang is not provided, then the minimum stall depth shall be 20 feet.
Sign requirements shall be as per Article XXXVI, § 245-312 et seq., of this chapter.
A. 
Recreation shall be in accordance with that required in the R-M Zone, § 245-159B.
B. 
Sidewalks.
(1) 
Old Squan Road.
(a) 
Sidewalks shall be provided along Old Squan Road if:
[1] 
A new access road to Old Squan Road is constructed; and/or
[2] 
The Planning Board determines that the provision of sidewalks is reasonably feasible.
(b) 
Any sidewalk required along Old Squan Road shall be run only between any new access road and a walkway from Old Squan Road providing access to the existing garden apartment complex.
(2) 
Internal sidewalks shall be provided for building access from parking areas and to permit safe pedestrian access to the existing garden apartment complex.
C. 
A fifty-foot vegetation buffer shall be permanently maintained along Old Squan Road. A ten-foot buffer shall be permanently maintained along all other property lines (except with the existing garden apartment complex). These buffers shall meet the requirements of § 245-409, except as modified herein.

The provisions of this article are subject to the mandatory fee contribution to the Brick Township Affordable Housing Trust Fund established in Article VI.
