A code regulating retail food-handling establishments,
providing for the inspection of such establishments and fixing penalties
for violations, is hereby established pursuant to N.J.S.A. 26:3-69.1
to 26:3-69.6. A copy of said code is annexed hereto and made a part
hereof without the inclusion of the text thereof herein.
Each licensee shall pay a license fee for the issuance of a license to operate a retail food establishment or other business in the Borough of Norwood as indicated in Chapter
240, Fees.
Nursery schools preparing food or representatives
of the nursery schools preparing food must take the three-hour food
handlers' course.
All food service establishments and mobile units
shall be subject to complete inspection during each business year,
without advance notice to the licensee to determine compliance with
the provisions of this chapter and with the provisions of Chapter
12 of the New Jersey State Sanitary Code. The licensee and operators
of all such establishments shall cooperate fully during such inspections.
In the event that an aforementioned facility does not receive a satisfactory
rating, the inspector shall return within a reasonable time for a
first reinspection to determine whether compliance has been accomplished.
In the event that it has not been achieved, the licensee must show
cause at an informal hearing of the Board of Health as to why compliance
has not been achieved. In that event, a second reinspection shall
be $250. If upon completion of a second reinspection it is again determined
that compliance has not been achieved, the licensee shall show cause
at an informal hearing before the Board of Health as to why the license
should not be revoked. The fee for such a hearing and a third inspection
shall be $500. As a result of repeated violations, the Board of Health
may issue an interim or temporary license for a specific period of
time and shall be entitled to a processing fee of $75 for each such
issuance.
Any person who violates any provision of or
order promulgated under this chapter shall, upon conviction thereof,
be liable to a penalty of not less that $50 nor more than $1,000 for
each violation. Each day a particular violation continues shall constitute
a separate offense.
