[HISTORY: Adopted by the Board of Health of the Borough of Norwood 6-4-1997 as part of Ord. No. 97:07. Amendments noted where applicable.]
A code regulating retail food-handling establishments, providing for the inspection of such establishments and fixing penalties for violations, is hereby established pursuant to N.J.S.A. 26:3-69.1 to 26:3-69.6. A copy of said code is annexed hereto and made a part hereof without the inclusion of the text thereof herein.
A. 
No retail food establishment, including restaurants, diners and any other establishments selling or serving food to the public in the Borough of Norwood, shall be granted a retail food establishment license unless the owner, manager or employee in charge of other employees serving food on each particular shift has successfully completed a course prescribed by the Norwood Board of Health pertaining to health, education, sanitation, personal hygiene, food-borne illness, dishwashing procedures, insects and rodents and other health related matters. There are two such courses: an eighteen-hour food managers' certification course and a three-hour food-handlers' course. The owner, manager and employees in charge of other employees serving food on a particular shift shall have completed the three-hour food-handlers' course. The certificate of satisfactory completion of the three-hour food-handlers' course shall be effective for two years from the date of its issuance and shall be a prerequisite to any license being issued to a retail food establishment after the appropriate fee has been paid.
B. 
Additionally, commencing January 1, 1997, or such date as may be fixed by the Norwood Board of Health, each owner or key management personnel actively involved in the daily operation of a retail food establishment where food is prepared is required to take the first available eighteen-hour food managers' certification course and employees in charge of other employees serving food on a particular shift must take the three-hour food-handlers course. The Norwood Board of Health shall issue a temporary retail food license which shall remain in effect for 90 days from the date of its issuance or until the required eighteen-hour food managers' certification course and three-hour food-handlers course has been given and satisfactorily completed. For the issuance of such a temporary retail food license, the retail food establishment shall pay the normal fee charged for the permit, together with a special surcharge for the temporary retail food license in the amount of $25. No part of the surcharge shall be returned.
C. 
If there is no owner, manager or employee in charge of other employees serving food to others on each particular shift who has satisfactorily completed the eighteen-hour food managers' certification course or three-hour food-handlers course in accordance with this chapter, then the retail food establishment shall be issued a summons to appear before the Norwood Board of Health to answer the violation.
A. 
Any retail food establishment which receives an unsatisfactory rating from the appropriate official inspecting the premises shall immediately cease from serving any food or similar products until the licensee has received a satisfactory rating from the Inspector conducting such inspections.
B. 
Any retail food establishment which receives two unconditional satisfactory ratings within any one-year period shall have its owner or manager appear at the next meeting of the Norwood Board of Health to show cause why its license shall not be suspended for failing to operate its premises in accordance with Chapter 12 of the New Jersey Sanitary Code. The conditional satisfactory rating shall be posted in the premises for such time as the Board of Health and/or Inspector believes it is necessary for the preservation of the public health and safety. In addition, its owner or manager must take and satisfactorily complete the next available eighteen-hour food managers' certification course.
C. 
In addition to the remedies stated above, the Inspector conducting the inspections shall cause appropriate summons to be issued for the violation of Chapter 12 of the New Jersey Sanitary Code, the ordinances of the Borough of Norwood and applicable statutes of the State of New Jersey.
Each licensee shall pay a license fee for the issuance of a license to operate a retail food establishment or other business in the Borough of Norwood as indicated in Chapter 240, Fees.
A. 
A retail food establishment license issued under the provisions of this chapter shall expire annually on December 31 of each year, and application for renewal thereof shall be submitted, together with the required fee, prior to February 1 of each year.
B. 
A retail food establishment license issued by another Board of Health in an additional municipality is no transferable as to another license.
C. 
All licenses shall be issued by February 15 of the new calendar year and shall be renewed not later than January 31 in any calendar year.

D. 
A late charge of 50% will be added to the license if not renewed by January 31 of that same year. All applicants for licenses or permits shall furnish any and all information required by the Board of Health. Any false or misleading information shall constitute sufficient cause to refuse a license or for the revocation of a license already issued.

A. 
As concerns nonprofit organizations, whenever food is being prepared at any of these facilities, a temporary permit, exempt from fees, must be obtained from the Board of Health two weeks prior to the date of the function. In order to obtain this permit, the following information must be provided:
(1) 
Date and length of function.
(2) 
Type of food being prepared.
(3) 
Approximate number of people being served.
B. 
Each nonprofit organization which prepares and serves food, in addition to the matters set forth above in Subsection A, should have someone from their organization take the three-hour food handlers' course.
Nursery schools preparing food or representatives of the nursery schools preparing food must take the three-hour food handlers' course.
All food service establishments and mobile units shall be subject to complete inspection during each business year, without advance notice to the licensee to determine compliance with the provisions of this chapter and with the provisions of Chapter 12 of the New Jersey State Sanitary Code. The licensee and operators of all such establishments shall cooperate fully during such inspections. In the event that an aforementioned facility does not receive a satisfactory rating, the inspector shall return within a reasonable time for a first reinspection to determine whether compliance has been accomplished. In the event that it has not been achieved, the licensee must show cause at an informal hearing of the Board of Health as to why compliance has not been achieved. In that event, a second reinspection shall be $250. If upon completion of a second reinspection it is again determined that compliance has not been achieved, the licensee shall show cause at an informal hearing before the Board of Health as to why the license should not be revoked. The fee for such a hearing and a third inspection shall be $500. As a result of repeated violations, the Board of Health may issue an interim or temporary license for a specific period of time and shall be entitled to a processing fee of $75 for each such issuance.
Any person who violates any provision of or order promulgated under this chapter shall, upon conviction thereof, be liable to a penalty of not less that $50 nor more than $1,000 for each violation. Each day a particular violation continues shall constitute a separate offense.
