Whenever a term is used in this chapter which
is defined in c. 291, P.L. 1975, such term is intended to have the meaning set forth in
the definition of such term found in said statute, unless a contrary
intention is clearly expressed from the context of this chapter.
All sections of the Land Subdivision Ordinance,
Zoning Ordinance, Site Plan Review Ordinance or any other ordinance
of the Borough of Bradley Beach which contains provisions contrary
to the provisions of this chapter or c. 291, P.L. 1975, Municipal
Land Use Law of 1975, shall be and are hereby (to the extent of such inconsistency)
repealed.
Pursuant to the provisions of c. 291, P.L. 1975,
Sections 77 and 81, the substantive provisions of the existing Zoning
Ordinance, adopted by the Borough of Bradley Beach on December 11,
1923, entitled "An Ordinance of the Borough of Bradley Beach dividing
the Borough into districts and regulating the uses for which buildings
within such districts may or may not be erected or altered and designating
the trades and industries that shall be excluded from such districts;
and regulating the number of houses that may be erected on a lot"
and all supplements, additions and amendments thereto, and the substantive
provisions of the existing Master Plan adopted on December 2, 1975,
shall continue in full force and effect for a period of 18 months
from the effective date of said act or until the Borough exercises
the authority delegated by said act to regulate development, whichever
occurs first.
All applications for development filed prior to the effective date of this chapter may be continued, but any appeals arising out of decisions made on any such application shall be governed by the provisions of Article
IV of this chapter.
This chapter shall be known and may be cited
as the "Land Use Procedures Ordinance of the Borough of Bradley Beach."
This chapter shall take effect on January 31,
1977.
Immediately upon adoption of this chapter, the
Municipal Clerk shall file a copy of this chapter with the County
Planning Board as required by law. The Clerk shall also file with
said County Planning Board copies of all other ordinances of the municipality
relating to land use, such as the subdivision, zoning and site plan
review ordinances.
