A. 
The City Solicitor shall be appointed by the City Council and shall be appointed for a term of one year, beginning on the first day of January of the year of appointment, and shall serve until his or her successor has been appointed and qualified. The Solicitor shall be an attorney at law of the State of New Jersey, but need not be a resident nor maintain an office in the City of Brigantine.
B. 
The City Solicitor shall receive such salary and other compensation as is authorized by the Annual Salary Ordinance of the City of Brigantine.[1] In addition thereto, the Council or the Manager may from time to time assign such additional work to the Solicitor according to a professional services contract to be approved by the Council.

C. 
The City Solicitor shall have such powers and perform such duties as are provided for the office of City Solicitor by general law or ordinances of the City of Brigantine. The Solicitor shall give all legal counsel and advise where required by the Manager, the Mayor, the Council, or any member thereof, or the Clerk and shall in general serve as the legal advisor to the Council and Manager on all matters of City business. In furtherance of such general duties, the City Solicitor shall:
(1) 
Represent the City in all judicial and administrative proceedings in which the City of any or its officers or agencies may be a part or have an interest.
(2) 
Draft or approve as to form and sufficiency all legal documents, contracts, deeds, ordinances and resolutions made, executed or adopted by or on behalf of the City.
(3) 
Conduct appeals from orders, decisions or judgments affecting any interest of the City as may be determined to be necessary or desirable, as directed by the Mayor, the Manager or the Council.
(4) 
Have the power to enter into any agreement, compromise or settlement of any litigation, subject to the approval of Council.
(5) 
Render opinions, in writing, upon any question of law submitted for such purpose by the Manager or Council or any member thereof.
(6) 
Perform such duties as may be necessary to provide legal counsel to the Manager or the Council in the administration of City affairs.
(7) 
Supervise and direct the work of such additional attorneys and legal-technical and legal-professional assistants as the Council may authorize for special or regular employment.
(8) 
Deliver to the Manger such products of work, reports, memoranda and City property as are generated for and use on behalf of the City, except, however, that the files and materials generated by the Attorney for his or her own use in the preparation of work for the City shall remain the property of the Attorney.
(9) 
Act as and for the City Prosecutor in the temporary absence of the Assistant Solicitor assigned for such purpose.
D. 
The Solicitor may not designate a substitute to perform duties of the Solicitor, except for brief absences, notice of which shall be reasonably given to the Manager and the Council in advance of such absence.
A. 
The City Prosecutor shall be an Assistant Solicitor of the City and shall be appointed by the City Council and shall be appointed for a one-year term, beginning on the first day of January of the year of appointment, and shall serve until his or her successor has been appointed and qualified. The City Prosecutor shall be an attorney at law of the State of New Jersey and need not be a resident of the municipality nor maintain an office in the City of Brigantine.
B. 
The City Prosecutor shall receive such compensation in the form of salary, or according to a professional services contract, as the Council shall direct.
C. 
The City Prosecutor shall prosecute on behalf of the State of New Jersey and the City of Brigantine.
D. 
The City Prosecutor shall perform such other duties as are assigned by the Council, the Manager and the City Solicitor and in accordance with the portions of this chapter applicable to the City Solicitor and shall further:
(1) 
Prosecute any cases which are to be tried in the Municipal Court of the City of Brigantine or in such courts as are directed by a Judge sitting in and for the Municipal Court of the City of Brigantine or courts having supervision and appellate jurisdiction over the Municipal Court of the City of Brigantine.
(2) 
Perform all duties as are assigned from time to time by the Charter, this chapter, the general police power, the laws of the State of New Jersey and the ordinances of the City of Brigantine or as promulgated by the City Council of Brigantine.
E. 
The City Prosecutor shall not designate any substitute to appear on behalf of the City of Brigantine without the prior permission of the City Solicitor, the Manager or the Council.
A. 
The City Public Defender shall be an Assistant City Solicitor for purposes of appointment and shall be appointed by the City Council and shall be appointed for a one-year term, beginning on the first day of January of the year of appointment, and shall serve until his or her successor has been appointed and qualified. The Public Defender shall be an attorney at law of the State of New Jersey.
B. 
The City Public Defender shall receive such salary or compensation according to a professional services contract, as the Council shall direct.
C. 
The City Public Defender shall provide a defense to such persons accused in the Municipal Court of Brigantine as the Judge of the Municipal Court, or Judges supervising that Court, shall direct.
D. 
The City Public Defender shall not designate any substitute to appear on behalf of defendants without the prior permission of the Manager or Council.
A. 
There shall be a City Engineer appointed by the Manager for a term not to exceed three years. The Engineer shall be a licensed professional engineer, as certified by the applicable licensing authorities of the State of New Jersey.
B. 
The Engineer shall receive such salary and compensation and may also receive additional compensation according to a professional services contract or contracts, as the Council shall direct.
C. 
The Engineer shall perform such duties as are prescribed by general law and ordinance or as directed by Council resolution. In addition thereto, the Engineer shall perform any and all functions as required by the job description for said position as developed by the City Manager.

A. 
There shall be a City Planner, who shall be appointed by the Manager for a term of up to one year and shall serve at the pleasure of the Manager and shall be compensated pursuant to the terms of a contract authorized annually by the Council.
B. 
The City Planner shall be a professional planner duly licensed by the State of New Jersey.
C. 
The Planner shall perform such duties as may be directed by the Manager. The Planner shall also attend such meetings of the Planning Board and Zoning Board of Adjustment as required. All papers, reports or work product reports and other materials created by or relative to the performance of the Planner's duties shall be and remain the property of the City, except for such files created solely for the Planner's own use.
A. 
There is hereby created the position of City Auditor, who shall serve as the professional advisor responsible for creating and promulgating the official audit of the financial activities of the municipality, as such is required and directed by the laws of the State of New Jersey, and report the same to the City Council.
B. 
The City Auditor shall have the qualifications of a registered municipal accountant, as such is certified by the State of New Jersey, and shall serve a term of one year.
C. 
The City Auditor shall render such professional accounting advice as is requested and required by the Manager and the Chief Financial Officer according to a contract for professional services to be negotiated by the Manager and approved by the City Council.
D. 
Vacancies in the office of the City Auditor shall be appointed by the City Council.
